Miller, Architect & Associates, Inc. 350 W. 5th Street, Suite 201 San Bernardino, CA 92401 OWNER: The Church of Jesus Christ of Latter-Day Saints 61 East North Temple Street Salt Lake City, Utah 84150 LOCATION: 440 North Loara Street CEQA STATUS: Categorically-Exempt, Class 5 DATE NOTICES MAILED: August 18, 1995 REQUEST: Waiver of the following to construct a wrought iron fence: Sections 18.04.043.101(cl - Maximum fence height. 18.04.043.102 6 feet permitted in minimum front and side 18.12.080.015 setbacks in the RS-10,000 Zone; and 18.25.064.110 8 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been. received, I do hereby find, pursuant to Section 18.12.080: That the request is hereby granted in accordance with Subsection 18.12.080.015 of the Anaheim Municipal Code which permits waiver of maximum fence heights in connection with administrative adjustments; 2. That no written opposition was received during the required 10-day notification period which ended on August 28, 1995; CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 5, as defined in the State of California Environmental Quality Act Guidelines and is, therefore, categorically exempt from the requirement to prepare an Environmental Impact Report. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 0097, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subject property shall be deveioped substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. adj-0097.wp - 1 of 2 - ZA 95-22 s • 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. This decision is made, signed, and entered into the file this 7th day of September 1995.
