Farner 165 South Bonnie Gene Lane Anaheim, CA 92808 AGENT: Joseph Morrison 1101 Victoria, Suite M Costa Mesa, CA 92627 LOCATION: 165 South Bonnie Gene Lane CEQA STATUS: Categorically Exempt, Class 5 DATE NOTICES MAILED: October 27, 1995 REQUEST: Waiver of the following to construct a 135 sq.ft. room addition: Sections 18.12.080.0101 - Minimum front yard setback. and 18.26.063.010. 25 feet required; 23 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section i 8. i 2.080: That the request is hereby granted in accordance with Subsection 18.12.080.0101 of the Anaheim Municipal Code which permits waiver of minimum front yard setback in connection with an administrative adjustment if the deviation from the Code requirement is 20% or less; and that the proposal is an 8% deviation from Code; 2. That the proposed 2-foot building projection into the front yard amounts to less than 14 sq.ft. and that said projection will have the same 23-foot setback as the existing garage; and That no written opposition was received during the required 10-day notification period which ended on November 6, 1995; CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 5, as defined in the State of California Environmental Quality Act Guidelines and is, therefore, categorically exempt from the requirement to prepare an Environmental Impact Report. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No: 98, subject to the following conditions: That within a period of one (1) year from the date of this decision or prior to final building and zoning inspections, whichever occurs first, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2 and 3. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. adj-0098.wp - 1 of 2 - ZA 95-29 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
