ZA 2000-5 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 183 OWNER: Manuel Lopez 1144 North Medford Street Anaheim, CA 92801 LOCATION: 1144 North Medford Street CEQA STATUS: CEQA Categorically Exempt, Section 15061(b)(3) DATE NOTICES MAILED: December 30, 1999 REQUEST: Waiver of the following to construct a 6-foot high block wall in the side yard of a single-family residence located on a reverse comer lot in the RS-7200 (Residential, Single-Family) zone: Sections 18.04.043.101 (a) - Maximum fence heiraht. 18.04.043.102(d~ (3-foot his~h wall permitted in side yard along Glen Drive; 18.12.080.0151 6-foot high wall proposed) and 18.26.064.110 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the request is hereby granted in accordance with Subsection 18.12.080 of the Anaheim Municipal Code which permits waiver of maximum fence heights in required yams in connection with administrative adjustments. 2. That this fence height waiver pertains to a proposed 6-foot high block wall in the side yard (along Glen Drive) of a reverse comer lot developed with asingle-family residence; and that the existing side yard setback is nonconforming because the existing dwelling with attached garage encroaches into that side yarcf. 3. That the proposed fence height will not interfere with any lines-of-sight along the street, sidewalk or driveways because the proposed 6-foot high wall is located about 40 feet distant from the adjoining neighbor's driveway, and that said wall does not encroach into the front setback along Medford Street. 4. That no written opposition was received during the required 10-day notification period which ended on January 12, 2000 at 5:00 p.m. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 183, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. Adj-183.doc - 1 of 2 - ZA 2000-05 • 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Muniripal Zoning Code and any other applicable City, State and Federal regulations. Approval does not indude any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
