REQUEST: Waiver of the following to construct a 6-foot high block wal{ in the required side
yard adjacent to La Palma Avenue for an existing single-family residence in the
RS-7200 (Residential, Single-Family) Zone:
Sections 18.04.043.101 (a) - Maximum fence height.
18.04.043.102(d) 3 feet permitted in a residential side
18.12.080.015 yard abutting a primary arterial highway;
and 18.26.064.110 6 feet proposed along La Palma
Avenue)
DETERMINATION OF THE ZONING ADMINISTRATOR
Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced
Administrative Adjustment, and subject petition having been duly noticed and no written objections having
been received, I do hereby find, pursuant to Section 18.12.080:
1. That the request is hereby granted in accordance with Subsection 18.12.080.015 of the Anaheim
Municipal Code which permits waiver of fence height requirements in connection with
administrative adjustments.
2. That no written opposition was received during the required 10-day notification period which
ended on January 26, 2000.
3. That this residential parcel sides-on La Palma Avenue, a primary arterial highway, and shares a
rear property line with an adjoining residential parcel to the west; and that no lines-of-sight are
impacted by this proposal because there are no residential driveways on La Palma Avenue on
either subject parcel or the neighboring residential parcel to the west.
4. That if this residential corner parcel reared-on (instead of sided-on) La Palma Avenue, a six foot
block wall would be required along the rear property line (the arterial highway) and would be
permitted along a portion of the side property line adjoining the other street (Taormina Drive, in
this case) under subsection 18.04.047.030 pertaining to comer lots fomted by the intersection of
residential streets with arterial highways.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or his
authorized representative has determined that the proposed project is Categorically Exempt, Section
15061(b)(3), as defined in the State of California Environmental Quality Ad Guidelines and is, therefore,
categorically exempt from the requirement to prepare an Environmental Impact Report.

Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No.
186, subject to the following conditions:
That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plan is on file with the Planning
Department marked Exhibit No. 1; provided, however, that:
(a) The proposed block wall shall not be located within the fifty three (53) foot planned highway
right-of--way along La Palma Avenue, as designated on the Circulation Element of the
Anaheim General Plan and as specified in subsection 18.04.080.010 (pertaining to required
setbacks) of the Anaheim Munidpal Code; and
(b) The plans submitted by the property owner for a dty permit shall indude information (such as
color photographs) specifically showing that the proposed block wall is compatible (although
not necessarily identical) in appearance (i.e., design, material and color) wlth the existing
block wall along La Palma Avenue on subject property and with any adjoining block wall
along La Palma Avenue on the neighboring parcel to the west; and
(c) The plans submitted by the property owner for a dty permit shall also show the existing
andlor proposed landscaping between the new block wall and La Palma Avenue. Such
landscaping shall be planted and adequately maintained.
2. That within a period of one (1) year from the date of this decision, Condition No. 1, above-
mentioned, shall be complied with. Extensions for further time to complete this condition may be
granted in accordance with Section 18.03.090 of the Anaheim Municipal Code.
3. That approval of this application constitutes approval of the proposed request only to the extent that
lt complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not indude any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 3rd day of February, 2000.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or

I have keen appoirned Zoning Administrator by the Planning Director to decide the
above-referenced Administrative Adjustment for waiver of maximum fence height (3 feet
permitted, 4 feet proposed) to retain an existing 4-foot high block wall and wrought iron fence in the
required front yard of a single family residence in the RS-7200 zone at 226 South Grand Avenue.
Written objections were received during the ten-day public notice period ending on January 26,
2000, and, therefore, I am no longer authorized to act on this proposal unless a public hearing is first
conducted, as specified by Anaheim Municipal Code Section 18.12.080.
As you have requested, a public hearing has been scheduled for March 9, 2000. Please contact
