ZA 2000-08 A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP NO. 99-204 OWNER: TWA Anaheim Limited 200 East Long Lake Road, X1300 Bloomfield Hills, MI 48303 AGENT: Jeffery Farano Wager H. Kallaher 2300 East Katella Avenue, #235 Anaheim, CA 92806 LOCATION: 105-125 South Festival Drive HEARING DATE: January 27, 2000 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence in opposition was received. REQUEST: The petitioner requests approval of a two-lot commercial subdivision in Development Area 3 'Visitor Commercial° of the Festival Specific Plan (Specific Plan No. 90-01). Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Muniapal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: That the proposed map is consistent with Anaheim City General Plan and the Festival Specific Plan. 2. That the design or improvement of the proposed subdivision is consistent with the Anaheim General Plan and the Festival Specific Plan. 3. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 4. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. 5. That the site is large enough and physically suitable for the previously approved 128-unit hotel and additional future commercial development. 6. That the design of the subdivision or the proposed improvements will not cause any substantial environmental damage nor injure fish or wildlife or their habitat. 7. That the design of the subdivision or the type of improvements will not cause serious public health problems. 8. That the design of the subdivision or the type of improvements will not conflict with existing easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 9. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. TP99-204.doc - 1 of 2 - ZA 2000-08 CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposed two-lot commerdal subdivision in Development Area 3 of the Festival Specific Plan (SP 90-01), on an irregularly-shaped 4.42 acre property located at the southwest comer of Santa Ana Canyon Road and Festival Drive (a private street), having frontages of 85 feet on the south side of Santa Ana Canyon Road and 760 feet on the west side of Festival Drive, and further described as 105-125 South Festival Drive; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 15, under Section 15061(b)(3) of the State of California Environmental Quality Ad Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 99-204, subject to the following conditions: 1. That each parcel shall have separate double trash enclosures and that these trash storage areas shall be provided and maintained in locations acceptable to the Public Works Department, Streets and Sanitation Division, and in accoMance with approved plans on file with said Department. Said storage areas shall be designed, located and screened so as not to be readily identifiable from adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized dinging vines planted on maximum three (3) foot centers, or tall shnibbery. 2. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Streets and Sanitation Division for review and approval. 3. That an on-site trash truck turn-around area shall be provided in accordance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Streets and Sanitation Division. Said turn-around area shall be specifically shown on plans submitted for building permits. 4. That prior to final parcel map approval, all lots shall be assigned street addresses by the Building Division. 5. That the developer shall submit a water quality management plan (WQMP) sperifically identifying best management practices that will be used on-site to control predictable pollutants from storm water runoff. The WQMP shall be submitted to the Public Works Department, Development Services Division, for review and approval prior to grading plan approval. 6. That sewer and storm drain improvements within the parcels shall be privately maintained. 7. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Munidpal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarciing any other applicable ordinance, regulation or requirement.
