ZA 2000 -10 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 181 REQUESTED BY: Jerry Zamekee 1415 East Diana Avenue Anaheim, CA 92805 LOCATION: 1415 East Diana Avenue HEARING DATE: January 27, 2000 REQUEST: Waiver of the following to construct an extension on top of an existing block wall within the required side and rear setback areas of an existing single family residence: Sedions 18.04.043.102(a) - Maximum fence heioht. 18.12.080.015 6-foot high fence permitted in side and and 18.26.064.110 rear yards in RS-7200 toning; 7-foot. 6-inch high block wall proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Diredor to decide the above-referenced Administrative Adjustment, and subjed petition having been duly noticed and no written objedions having been received, I do hereby find, pursuant to Sedion 18.12.080: 1. That administrative adjustments can be granted in accordance with Subsedion 18.12.080.015 of the Anaheim Municipal Code, which permits waiver of fence heights when no opposition is received from property owners within 300 feet of a property following a 10-day notification period; however, when opposition is received, a public hearing shall be held, inGuding public notice pursuant to Title 18 "Zoning." 2. That opposition to this administrative adjustment was originally received during the 10-day public notification period (five letters and three telephone calls) and, therefore, a public hearing was scheduled in accordance with Subsedion 18.12.080 of the Anaheim Municipal Code. 3. That this proposal originally consisted of a 9-foot high block wall, but that the height was reduced to 7 feet, 6 inches; and that the public notification for the public hearing included the reduced block wall height and no correspondence or telephone calls were received in opposition to the lower height. 4. That the proposed 7-foot, 6-inch block wall is approved for the rear (north) property line and the side (east and west) property lines; and that the proposed block wall shall not encroach into the required 25-foot front yard. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 181, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subjed property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1; provided, however, that the seven m foot, six (6) inch high block wall shall be located at least twenty five (25) feet from the front property line along Diana Avenue. That prior to issuance of a City of Anaheim pemtit for the proposed block wall, the property owner shall provide evidence to the Zoning Division that the adjoining neighbors (to the north, east and west) have been contacted and do not oppose the proposal in terms of appearance on their sides of the wall (i.e., material, color, and finishing the joints between the blocks for visual compatibility with the existing wall). 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. This decision is made, signed, and entered into the file this 3rd day of February, 2000. NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or unless members of the City Council shall request to review this decision within said 15 days.
