Resolution-ZA 2000-16DECISION NO. ZA 2000-16 A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP N0.2000-118 OWNER: Pacific Homes L.L.C. Richer Masse 2760 Spring Street Long Beach, CA 90806 LOCATION: 1312 West La Palma Avenue This property is rectangularly shaped and consists of 0.56 acres located on the south side of La Palma Avenue approximately 1,310 feet east of the centerline of Euclid Street and 130 feet west of the centerline of Hermosa Drive. HEARING DATE: April 6, 2000 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: To establish a 3-lot single family residential subdivision in the RS-7200 (Residential, Single Family) Zone. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: That the proposed subdivision consists of three RS-7200-zoned parcels, all of which will take vehicular access from a new private drive/street along the west side of the property; that the specific configuration of this parcel map is entitled under Variance No. 4381 which was approved by the Planning Commission on December 6, 1999 under Resolution No. PC99-223 and waived requirements of minimum lot depth (120 feet measured from La Palma Avenue required, 63 feet proposed for one lot), minimum lot size (7,200 sq.ft. required, 6,881 sq.ft. proposed for two lots), minimum lot width (70 feet required, 20-63 feet proposed) and orientation of residential structures (dwellings required to rear-on arterial highways, one lot proposed to side-on La Palma Avenue); and that Condition No. 13 of said resolution requires that a parcel map be submitted to and approved by the City and then be recorded in the Office of the Orange County Recorder. 2. That this parcel map proposes a subdivision which is consistent with the applicable General Plan Low Density Residential land use designation. 3. That the proposed density for this subdivision is within the permitted density range as described in the Land Use Element of the City of Anaheim General Plan. 4. That the proposed subdivision will not adversely affect adjoining land uses and the growth and development of the area. 5. That the size and shape of the site is adequate to allow full future development of the subdivision in a manner not detrimental to the area. 6. That the traffic generated by the proposed subdivision will not impose an undue burden on the adjacent streets and highways. 7. That the design of the subdivision and the type of improvements will not conflict with easements acquired by the public at large for access through or use of the property within the proposed subdivision. TP2000-118.doc - 1 of 3 - ZA 2000-16 8. That granting of this tentative parcel map will not be detrimental to the peace, health, safety or general welfare of the citizens of Anaheim. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to establish a 3-lot "RS-7200" Residential, Single Family zoned subdivision under the authority of Code Section 18.12.045 on arectangularly-shaped 0.56-acre property having a frontage of 133 feet on the south side of La Palma Avenue and a maximum depth of 184 feet, being located 1,310 feet east of the centerline of Euclid Street, and further described as 1312 West La Palma Avenue; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 15, under the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 2000-118, subject to the following conditions: 1. That the developer shall construct a sidewalk and landscaped parkway adjacent to La Palma Avenue along the street frontage, and that the sidewalk shall connect to the sidewalks on the adjoining Tots to the east and west, to the satisfaction of the City Engineer. 2. That a twenty four and one-half (24.5) foot wide private access easement shall be reserved on the final parcel map for the benefit of each parcel established by this map and for public utilities, as required by the Public Works and Public Utilities Departments. 3. That an improvement certificate shall be placed on the final parcel map specifying the requirement to construct the private street improvements in accordance with City Standard 122-B, and for completing the necessary utility relocations prior to receiving approvals for development of any one of the proposed parcels (i.e., issuance of a building permitj. 4. That a maintenance agreement shall be submitted to the Subdivision Section of the Public Works Department and approved by the City Attorney's office. The agreement shall include provisions for the maintenance of the private facilities. A maintenance exhibit shall be included as part of the agreement. The agreement shall be recorded concurrently with the final map. 5. That an improvement certificate shall be placed on the final parcel map specifying the requirement to widen La Palma Avenue as required under the Circulation Element of the Anaheim General Plan or providing the monetary equivalent, to the satisfaction of the City Engineer. 6. That the legal property owner shall furnish a Subdivision Agreement, in a form approved by the City Attorney, to the City of Anaheim agreeing to complete the public improvements required as conditions of this parcel map at the legal property owner's expense. Said agreement shall be submitted to and approved by the City of Anaheim and shall then be recorded concurrently with the final map. 7. That Final Parcel Map No. 2000-118 shall be submitted to the Public Works Department, Development Services Division, for review and approval and then recorded in the Office of the Orange County Recorder. 8. That the legal property owner shall irrevocably offer to dedicate to the City of Anaheim (Water Engineering Division) an easement twenty (20) feet in width from the centerline of the water service mains for operation and maintenance purposes and/or an easement for large meters or fire lines installation. A wider easement may be required by the Water Engineering Division if additional facilities/utilities are installed in the easement. 9. That addresses for all three (3) parcels shall be prominently displayed along the La Palma Avenue frontage to the satisfaction of the Anaheim Police Department. That the property shall be provided with underground utilities per the Electrical Rates, Rules, and Regulations, and the City of Anaheim Underground Policy. 11. That prior to final parcel map approval, Condition Nos. 2, 3, 4, 5, 6, 8 and 15, herein-mentioned, shall be complied with. 12. That prior to issuance of a building permit, Condition No. 15, herein-mentioned, shall be complied with. 13. That prior to final building and zoning inspections, Condition Nos. 1, 9, 10 and 15, herein-mentioned shall be complied with. 14. That development of each of the parcels created by this subdivision shall comply with all the conditions of approval of Resolution No. PC99-223, adopted in connection with Variance No. 4381, which approved certain waivers allowing the specific configuration of the proposed parcels in this tentative map; and that such conditions shall be referenced, in the appropriate manner, on the final parcel map so-specifying to verify that future development of all three (3) parcels shall comply with Variance No. 4381. 15. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
