Sections 18.12.080.010.0103 - Minimum side yard setback. and 18.23.063.020 (10 feet required; 8 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Acting Zoning Administrator by the Planning Director to decide the above- referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: That the request is hereby granted in accordance with Subsection 18.12.080.010.0103 of the Anaheim Municipai Code which permits waiver of minimum side yard setback in connection with administrative adjustments if the deviation from Code does not exceed 20%; and that the proposed deviation is two feet (20%). 2. That no written opposition was received during the required 10-day notification period which ended on Monday June 12, 2000; Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2000-00196, subject to the following condition(s): 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Santalahti, Zoning Administrator, considered your request for Special Circumstances Waiver No. 2000-0004 to retain nineteen (19) pageantry-style banners mounted on light poles in conjunction with an automobile dealership at 1600 West Lincoln Avenue for an additional period of six months to expire January 27, 2001. She made the following findings: 1. That this proposal (as described in a letter dated June 12, 2000 and submitted by Joseph Perri, General Sales Manager, and in the Staff Report to the Zoning Administrator dated July 27, 2000, and as shown on the submitted exhibits) is for 19 pageantry-style banners mounted on light poles in conjunction with an automobile dealership for a period of six months; and that the property is developed with an automobile sales facility in the CH (Commercial, Heavy) zone. 2. That extraordinary circumstances still apply to this property beyond the control of the property owner or business owner due to on-going Lincoln Avenue road construction and Santa Ana (1-5) Freeway on- and off-ramp road construction in the immediate vicinity of this property. The impacts which affect Lincoln Avenue and Euclid Street in the area in which this property is located include lane closures, traffic congestion, difficult access, and limited visibility to this site. 3. That Special Circumstance Waiver No. 99-02 (permitting 19 banners mounted on light poles at this automobile dealership for a period of 6 months) was previously approved by the Zoning Administrator on December 30, 1999, and expired on June 14, 2000. 4. That approval of a Special Circumstances Waiver ("S.E.P.") allowing modification and/or waiver of regulations pertaining to special events, is authorized by Subsection 18.02.055.080 "Zoning Administrator Review" (of Special Events Permits) and Section 18.12.085 "Special Event Permit -Review" of the Anaheim Municipal Code. 5. That this request is for waivers of Code subsections 18.02.055.060.0607 and 18.02.055.060.0608 (maximum nine consecutive days permitted per S.E.P. and a maximum of four S.E.P.'s permitted per calendar year for a total of 36 days per calendar year; six additional months proposed). 200 South Anaheim Boulevard P.O. That roof-mounted inflatable devices are prohibited. Any violation of this requirement would be grounds for termination of this special circumstances waiver. This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within ten (10) days from the date of this letter or unless members of the City Council request review of this decision within said 10 days.
