Baird 8355 East Quiet Canyon Court Anaheim, CA 92808 LOCATION: 8355 East Quiet Canyon Court CEQA STATUS: Categorically Exempt, Section 15061(b)(3) DATE NOTICES MAILED: August 11, 2000 REQUEST: Waiver of the following to construct a 6 sq.ft. dining room addition in the required side yard setback of asingle-family residence in Development Area 104 (Hillside Medium) of The Summit Specific Plan (SP 88-2): Sections 18.12.080.0103 - Minimum side yard setback. and 18.72.070.040.G.2.b (5 feet required; 4 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the request is hereby granted in accordance with subsection 18.12.080.0103 of the Anaheim Municipal Code which permits waiver of minimum side yard setbacks in connection with an administrative adjustment if the deviation does not exceed 20% of the Code requirement. 2. That the request is minimal consisting of a 1-foot deep, approximately 6 sq.ft. encroachment into the 5-foot side yard. 3. That no written opposition was received during the required 10-day notification period. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2000-00198, subject to the following conditions: 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2 and 3. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
