ZA 2000-33 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2000-00199 REQUESTED BY: William Nuebling 1670 East Belmont Avenue Anaheim, CA 92805 LOCATION: 1670 East Belmont Avenue CEQA STATUS: Categorically Exempt, Section 15061(b)(3) DATE NOTICES MAILED: August 11, 2000 REQUEST: Waiver of the following to construct a 6 foot high wrought iron fence with a sliding gate in the required front yard setback of a single family residence in the RS-5000 (Residential, Single Family) Zone: Sections 18.04.043.101(x) - Maximum fence height. 18.12.080.015 (3 feet permitted in the 10-foot front setback along 18.27.063.010 Belmont Avenue; 6 feet proposed) and 18.27.064.100 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: That the request is hereby granted in accordance with Subsection 18.12.080.015 of the Anaheim Municipal Code which permits waiver of maximum fence heights in connection with an administrative adjustment. That no written opposition was received during the required 10-day notification period which ended on August 21, 2000 (a letter post marked the following day, August 22, 2000, was received after the notification period had ended). That the proposal consists of a decorative wrought iron fence with gates across the driveway and the sidewalk to the front door. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2000-00199, subject to the following conditions: That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
