Winn 939 South Caplan Street Anaheim, CA 92802 LOCATION: 939 South Caplan Street CEQA STATUS: CEQA Categorically Exempt, Section 15061(b)(3) DATE NOTICES MAILED: September 22, 2000 REQUEST: Waiver of the following to construct a 6-foot high combination wrought iron and block wall fence with a wrought iron gate in the required front yard setback of a single-family residence in the RS-7200 (Residential, Single-Family) Zone: Sections 18.04.043.100.101(a) - Maximum fence heioht. 18.12.080.015 3 feet high permitted in front 25 feet; 18.26.063.010 6 feet high proposed) and 18.26.064.110 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to dedde the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the request is hereby granted in accordance with Subsection 18.12.080.015 of the Anaheim Munidpat Code which permits waiver of maximum fence heights in connection with administrative adjustments. 2. That no written opposition was received during the required 10-day public notification period. 3. That the proposal consists of a combination of a 2-foot high block wall, with pilasters, topped by 4 feet of wrought iron fencing, with a wrought iron gate across the driveway. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2000-00201, subject to the following condition(s): 1. That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That the appropriate permits shall be obtained from the Building Division. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Munidpal Zoning Code and any other applicable City, State and Federal regulations. Approval does not indude any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. That a photograph of the property shows the block wall portion of the fence (which was under construction when the photograph was taken) in the context of the architectural style of the house.
