HEARING DATE: December 14, 2000 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal; one person spoke with concerns regarding the area; and no correspondence in opposition was received. REQUEST: To establish a 2-lot industrial subdivision on property zoned MH (Heavy Industrial). Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: That the proposed map is consistent with the Anaheim General Plan. 2. That the design and/or improvement of the proposed subdivision is consistent with the General Plan. 3. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 4. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. 5. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal to establish a 2 -lot industrial subdivision for an existing industrial property in the MH (Heavy Industrial Zone on irregularly-shaped, 8.2-acre property located at the southeast comer of Commercial Street and Anaheim Boulevard, with frontages of 1,250 feet on the south side of Commercial Street and 300 feet on the east side of Anaheim Boulevard, and further described as 1244 North Anaheim Boulevard and 110 East Commercial Street; and that the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 15, under the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 2000-204, subject to the following conditions: tpm2000-204.doc -1 of 2 - ZA 2000-204 • That if there is an intensification of land use or other similar improvements to this property, the legal property owner may be required to dedicate to the City of Anaheim an appropriate easement measured from the centerline of the street along Commercial Street for street widening purposes in accordance with the Circulation Element of the Anaheim General Plan. (If an exception to this requirement is sought, the property owner/developer may seek waiver of subsection 18.04.080.080 "Dedication and Improvements - General° of the Anaheim Municipal Code.) An improvement certificate indicating this possibility shall be placed on the final map. 2. That the developer shall construct a sidewalk and landscaped parkway on Anaheim Boulevartii and Commercial Street along the parcel frontages. An improvement certificate shall be placed on the final map indicating this requirement. 3. That prior to final parcel map approval, Condition Nos. 1 and 2, above-mentioned, shall be complied with. 4. That approval of this application constftutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Anaheim Boulevard. She made the following findings: 1. That city Traffic and Transportation staff have reviewed the plot plan and letter of operation, and do not oppose this three-day auto sales request. 2. That Section 18.02.055.080 of the Anaheim Municipal Code grants the Zoning Administrator the authority to approve a waiver from the Special Event Permit requirements (which permit events that are directly related to business activities at the underlying property); and that there are several auto- related businesses established on this property, including the installation and sales of auto stereos, alarms, windows, tires, detailing, and accessories. 3. That approval of this proposal shall not be considered a precedent to future similar requests. Based on the above findings, Special Circumstances Waiver No. 2000-00006 is approved, subject to the following conditions. (1) There can be a maximum of two hundred (200) for-sale cars on the site. (2) Any loading or unloading of for-sale cars shall be done on this property, and shall not take place on any adjacent street or on any adjacent property. (3) No special activity associated with this event shall be take place on the public streets (Anaheim Boulevard and Cerritos Avenue). (4) There shall be no food sales or give-aways on the property, with the exception of drinks such as coffee and soft drinks. (5) There shall be no inflated balloons of any size or type what-so-ever. (6) This event may include a disc jockey with music. (7) Any special signs on the property for this event shall be limited to banners attached to the tent, and there shall be no signs posted in the public right-of-way or off-site, with the exception of a person carrying a poster or sign advertising the event on or in front of this property. (8) All the necessary permits be obtained from the City, including a Special Event Permit and a permit for the tent. (9) The days of this event shall include the set up on Thursday, the event on Friday, Saturday and Sunday, and the take down on Monday. There will be no sales on Thursday or Monday.
