Resolution-ZA 2001-06• DECISION NO. ZA 2001-6 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE NO. 2001-04422 OWNER: Tri Star Group Inc. Attention: Pablo Villanueva 12741 Bellflower Road, #206 Downey, CA 90242 LOCATION: 140 South Hardins~ Avenue HEARING DATE: February 8, 2001 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: Petitioner requests waivers of the following to construct two-single family residences on separate lots in the RS-7200 (Residential, Single Family) Zone: (a) Sections 18.12.060.060 - Minimum lot area. and 18.26.061.010 (7.200 sg.ft. required; 6.776 soft. proposed) (b) Sections 18.12.060.080 - Minimum lot width. and 18.26.061.020 0 feet required; 50 feet existing and proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That waiver (a), minimum lot area, is a deviation of less than 6% (424 sq.ft.) from the required lot size. 2. That waiver (b), minimum lot width, is an existing condition of the subject property which has frontage on two streets with an current depth of 280 feet between those streets; and since the 50-foot width of this "through-lot" is an existing condition similar to other single-family lots in the area, this waiver will not have adverse impacts to the surrounding neighbofiood; and that other development standards pertaining to setbacks and lot coverage will be in compliance with the RS-7200 Zone standards as illustrated by the submitted site plan (Exhibit No. 1). 3. That strict application of the Zoning Code would deprive this property of privileges enjoyed by other properties with identical zoning classification in the vicinity. 4. That this site is physically suitable, for the type of development proposed. 5. That there are special circumstances including lot size, configuration and width applicable to this property that would allow for development similar to existing adjacent properties in the area. 6. V2001-04422.doc - 1 of 2 - ZA 2001-6 • • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum lot area and minimum lot width to construct a two single- family residences on two proposed lots in the RS-7200 (Residential, Single-Family) Zone on 0.32-acre rectangularly-shaped property having frontages of 50 feet on the east side of Harding Avenue and 50 feet on the west side of Grand Avenue, with a maximum depth of 280 feet, being located 140 feet north of the centerline of Del Monte Drive, and further described as 140 South Harding Avenue; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 2001-04422, subject to the following conditions: 1. That approval of this variance is granted subject to approval of Tentative Parcel Map No. 2000-243, now pending, and to recordation of the Final Parcel Map at the Office of the Orange County Recorder. 2. That trash storage areas shall be provided and maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. 3. That subject property shall be developed generally in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2 and 3, and as conditioned herein. 4. That within a period of one (1) year from the date of this decision, or prior to commencement of the activity authorized by this decision, or prior to issuance of a building permit, whichever occurs first, Condition No. 1,above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 5. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
