Resolution-ZA 2001-30 DECISION NO, ZA 2001-30 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2001-00213 REQUESTED BY: David and Susan Bailey 3244 East Radcliffe Avenue Anaheim, CA 92806 OWNER: Landmark Remodelers Attn: Jerry Lutjens 19953 Valley Boulevard Walnut, CA 91789 LOCATION: 3244 East Radcliffe Avenue CEQA STATUS: CEQA Categorically Exempt, Class 1 DATE NOTICES MAILED: August 10, 2001 REQUEST: Waiver of the following to construct a dining room addition at the rear of an existing single family residence in the RS-5000 (SC)(Residential, Single-Family - Scenic Corridor Overlay) Zone: Sections 18.12.080.020 - Maximum lot coverage. 18.27.062.030 (35% permitted; 37.6% proposed) and 18.84.042 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: That the proposed addition to the existing one-story dwelling is a dining area at the rear of the residence. 2. That the request is hereby granted in accordance with Subsection 18.12.080.020 of the Anaheim Municipal Code which permits waiver of maximum lot coverage in connection with administrative adjustments if the deviation does not exceed 10% of the Zoning Code requirement; and that the proposed lot coverage (2,035 sq.ft.) is only 7% (130 sq.ft.) more than permitted by Code (1,905 sq.ft.) for this residential lot. 3. That no written opposition rEgarding the proposed waiver of maximum tot coverage (35% permitted, 37.6% proposed) for cone-story rear addition in conjunction with an existing single-family dwelling was received during the required 10-day notification period which ended on Wednesday, August 22, 2001 at 5:00 P.M. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2001-00213, subject to the following condition(s): 1. That the subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department Marked Exhibit Nos. 1 and 2. Adj2001-00213.doc - 1 of 2 - ZA2001-30 2. That within a period of one (1 }year from the date of this decision, the applicant shall obtain the appropriate building permits for the addition from the city. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
