Katella, Ste. 640 Anaheim, CA 92806 LOCATION: 4910 Copa De Oro Drive CEQA STATUS: CEQA Categorically Exempt, Class 1 DATE NOTICES MAILED: September 21, 2001 REQUEST: Waiver of the following to permit and retain a 2-story single family residence in the RS- HS-22,000(SC) "Residential, Single-Family Hillside-Scenic Corridor Overlay" Zone: Sections 18.12.080.010.0101 - Minimum front yard setback. and 18.23.063.010.011 (25 feet required; 23 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the reason for the 23-foot front setback from Copa de Oro Drive (a private street) is a survey error which was discovered after the house was constructed. 2. That the request is hereby granted in accordance with Subsection 18.12.080 of the Anaheim Municipal Code which permits waivers of dimensional requirements for front yard setbacks in connection with administrative adjustments if the deviation does not exceed 20%, and the proposal is only 8% (2 feet) less than required by Code; and that only a corner of the house is within the required setback. 3. That no written opposition was received during the required 10-day notification period which ended on Monday, October 1, 2001. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or his authorized representative has determined that the proposed project is Categorically Exempt, Class 1, as defined in the State of California Environmental Quality Act Guidelines and is, therefore, categorically exempt from the requirement to prepare an Environmental Impact Report. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2001- 00214, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 5. That a correction to the site plan (filed with Building Permit No. BLD2000-00483 issued for this house) showing the accurate dimensions of subject property and the twenty three (23) foot front setback between the house and Copa de Oro Drive (a private street) shall be submitted to the Building Division. That within a period of one (1) year from the date of this decision, Conditions 1 and 2, above- mentioned, shall be complied with. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
