ZA 2001-43 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE NO. 2001-04464 OWNER: Boeing North American, Inc. 1230 North Miller Street Anaheim, CA 92806 AGENT: Tim Palmquist 3151 Airway Avenue, #F-203 Costa Mesa, CA 92626 LOCATION: 3350-3410 East Miraloma Ave. and 1124-1292 North Miller Street. HEARING DATE: November 15, 2001 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and no correspondence in opposition was received. REQUEST: Petitioner requests waiver of the following to establish a 7-lot industrial subdivision in Development Areas 2 and 3 (Expanded Industrial and La Palma Core) of the Northeast Area Specific Plan No. 94-1 zone: Sections 18.01.130 - Required lot frontage on a public or private street. and 18.12.060.075 (Street frontage required for all parcels; frontage on drive aisles proposed for Parcel Nos. 3 and 4) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That there are special circumstances pertaining to the property consisting of its unusual size and irregular shape of this site which to not apply to other similarly zoned properties within the immediate vicinity that prevent the creation of street frontages for Parcel Nos. 3 and 4. 2. That the strict application of this Zoning Code would deprive this property of privileges enjoyed by other properties in Northeast Area Specific Plan area, where existing lots in an industrial complex (Boeing, formerly Rockwell) to the west of the subject site have no lot frontage to a public or private street. 3. That appropriate vehicle access will be provided to Lot Nos. 3 and 4 because an unsubordinated restricted covenant will be recorded with the proposed parcel map, which was filed concurrently with this variance, to provide reciprocal access and parking across the entire subject property. 4. That this variance is being processed concurrently with Tentative Parcel Map No. 2001- 161 to establish a 7-lot industrial subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of required lot frontage on irregularly-shaped 38.6-acre property located at the southeast corner of Miraloma Avenue and Miller Street, with frontages of 621 feet on the south side of Miraloma Avenue and 2,265 feet on the east side of Miller Street, with a maximum V2001-04464.doc - 1 of 2 - ZA 2001-43 • i depth of 940 feet, and being further described as 3350 - 3410 East Miraloma Avenue and 1124 -1292 North Miller Street; and does hereby approve the Negative Declaration upon finding that she has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 2001-4464, subject to the following conditions: 1. That all requests for new water services or fire lines, as well as any modifications, relocations, or abandonment of existing water services and fire lines, shall be coordinated through the Water Engineering Division of the Anaheim Public Utilities Department. 2. That trash storage areas shall be provided and maintained in locations acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Said storage areas shall be designed, located and screened so as not to be readily identifiable from adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized clinging vines planted on maximum three (3) foot centers or tall shrubbery. Said information shall be specifically shown on the plans submitted for Planning Department and Public Works Department, Streets and Sanitation Division, approval. 3. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Public Works Department, Streets and Sanitation Division, for review and approval. 4. That an on-site trash truck turn-around area shall be provided in compliance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Public Works Department, Streets and Sanitation Division. 5. That each parcel shall have separate trash enclosures. 6. That the property shall be served with underground utilities in accordance with the Electrical Rates, Rules and Regulations and the City of Anaheim Underground Policy. 7. That any required relocation of City electrical facilities shall be at the developer's expense. Further, landscape and/or hardscape screening of all pad-mounted equipment shall be required. 8. That the on-site landscaping and irrigation system shall be maintained in compliance with City standards. 9. That the proposal shall comply with all signing requirements of the Northeast Area Specific Plan (SP94-1) unless a variance allowing sign waivers is approved by the Planning Commission or City Council, Planning Commission. 10. That three (3) foot high street address numbers shall be displayed on the roofs of all existing buildings in a contrasting color to the roof material. The numbers shall not be visible to the adjacent streets or adjacent properties. 11. That the approval of Variance No. 2001-04464 is hereby granted subject to the approval of Tentative Parcel Map No. 2001-161. 12. That individual water service and/or fire line connections will required for each parcel or industrial unit in accordance with Rule 18 of the City of Anaheim Water Rates, Rules and Regulations. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2, and as conditioned herein. 14. That prior to recordation of Final Parcel Map No. 2001-161 or within a period of two (2) years from the date of this decision, whichever occurs first, Condition Nos. 1, 2, 3, 4, 5, 10 and 12, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 15. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
