That the request fora 2,200 sq.ft. interior mezzanine is hereby granted in accordance with Subsection 18.12.080.020 of the Anaheim Municipal Code which permits waiver of the maximum floor area ratio in connection with an administrative adjustment if the deviation from the Code requirement does not exceed 10%; and that the proposal is a 4% deviation from Code. 2. That no written opposition was received during the required notification period which ended on February 19, 2003. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2003-00238, subject to the following conditions: That within a period of one (1) year from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No.. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. Santalahti, Zoning Administrator, approved your request for Special Circumstances Waiver No. 2003-00021 to permit a temporary trailer, a banner and three small directional signs until March 1, 2003 in conjunction with a health club which is under construction at 1430 North Lemon Street (24-Hour Fitness Sport Club), subject to certain conditions. As discussed in the Staff Report to the Zoning Administrator dated February 20, 2003, Chris Bailey, Director of Construction for 24-Hour Fitness Health Club, has submitted correspondence (a letter and a-mail) asking that the temporary trailer, banner and three directional signs (approved in connection with Special Circumstances Waiver No. 2003-00021) be allowed to remain until May 15, 2003 due to weather and certain construction issues which have delayed completion and opening of the a health club. On February 20, 2003, Ms. Santalahti considered your request for Special Circumstances Waiver No. 2002- 00022 to permit and retain a temporary trailer, a banner and three small directional signs until completion and opening of the health club at 1430 North Lemon Street, and made the following findings: 1. That the temporary trailer has had a negligible effect on the parking lot and circulation, as well as the streets and highways in the area which are equipped to handle large traffic flows. 2. That the proposed temporary trailer and banner and signs have not adversely affected the adjoining land uses and the growth and development of the area in which they are located. Under authority of subsection 18.02.055.080 and Section 18.12.085, and based on the above findings as well as the findings previously made in connection with Special Circumstances Waiver No. 2003-00021, the Zoning Administrator approved Special Circumstances Waiver No. 2002-00022 for the herein described special event until May 15, 2003, subject to compliance with the following conditions: That the property shall be limited to one (1) banner with a maximum area of thirty six (36) square feet, which is mounted on the pre-sale trailer (which is twelve (12) feet wide by sixty (60) feet long). 2. That three (3) directional signs (three (3) square feet, each, and approximately three (3) to four (4) feet high) located in the setback along Lemon Street at the northeast and southeast corners of the northern entrance driveway and Lemon Street, and at the northeast corner of the southern driveway and Lemon Street are approved. Additionally, the exact location of the directional signs shall comply with subsection 18.05.093.070 "Minimum Sight Distance Requirements for Freestanding Signs (at intersection of streets or streets and driveways)" of the Anaheim Municipal Code. 3. That any hot-air balloons, roof-mounted inflatable devices, portable signs, and freestanding directional signs (except as approved herein) shall be prohibited. That the locations and appearances of the trailer, banner and directional signs are illustrated on Exhibit Nos. 1 (Site Plan), 2 (directional signs), and 3 and 4 (photographs of similar directional signs), which drawings and photographs were submitted by the petitioner; and that the applicant shall maintain the banner and directional signs in good repair. 5. That the temporary trailer, banner and directional signs shall be removed from the premises on or before May 16, 2003. This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within ten (10) days of the date of this letter or unless member of the City Council request review of this decision with'sn said 10 days.
