Taft Avenue Orange, CA 92865 LOCATION: 1 17 acres located on the southeast side of Imperial Highway west of Hudson Bay Drive (a private street) DATE NOTICES MAILED: February 21, 2003 REQUEST: Waiver of the following to construct an 8-foot high concrete masonry sound wall in the RS-HS-10,000(SC) (Residential, Single Family Hillside -Scenic Corridor Overlay) Zone: Sections 18.04.043.100.102(a) - Maximum fence height. 18.12.080.015 (3-foot height permitted in 6-foot side yard; 18.24.063.020 8-foot height proposed adjacent to Imperial and 18.24.064.100 Highway) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the proposal is for a sound wall to buffer residential uses from traffic along Imperial Highway, a primary arterial highway which crosses the ridge line between Anaheim Hills and the City of Orange; and that screen landscaping will be provided along the sound wall in a 3-foot wide planting area between the wall and the highway . 2. That the request is hereby granted in accordance with Subsection 18.12.080 of the Anaheim Municipal Code which permits waivers of maximum fence height in connection with administrative adjustments for fences located in side yards. 3. That no written opposition was received during the required 10-day notification period. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2003-00235, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 (site plan), 2 (planting plan), 3 (wall elevation plan) and 4 (sound wall details). 2. That irrigation facilities shall be installed for the three (3) foot wide planter area between the sound wall and Imperial Highway. Adj2003-00235.doc -1 of2- ZA2003-07 1 • • 3. That the location of the sound wall shall be subject to review and approval by the City Traffic and Transportation Manager to verify that appropriate lines-of-sight will be provided between traffic (both vehicular and pedestrian) along Imperial Highway and Hudson Bay Drive (a private street). 4. That the appropriate permits shall be obtained from the Building Division for the sound wall and the irrigation facilities. That within a period of one (1) year from the date of this decision, Condition Nos. 1, 2, 3 and 4, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 6. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
