ZA 2003-17 • A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2003-00242 REQUESTED BY: Patrick and Carol Kilgore 420 Paseo Estrella Anaheim, CA 92807 OWNER: Craig Beinlich 5525 E. 7'h Street, #D Long Beach, CA 90804 LOCATION: 420 Paseo Estrella DATE NOTICES MAILED: May 2, 2003 REQUEST: Waiver of the following to permit a first and second story addition to an existing single-family residence in the RS-5000(SC) (Residential, Single Family -Scenic Corridor Overlay) Zone: (a) Sections 18.12.080.020 - Maximum structural height. and 18.84.042.010 (25 feet permitted in the Scenic Corridor Overlay; 27'/ feet proposed) (b) Sections 18.12.080.020 - Minimum open space. 18.27.061.010 (7,550 square foot lot required for asix-bedroom house; and 18.27.062.031 6,969 square foot lot existing) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the request is hereby granted in accordance with Subsection 18.12.080.020 of the Anaheim Municipal Code which permits waivers of maximum structural height and minimum open space in connection with administrative adjustments if the deviation from the Code requirements does not exceed 10%; and that the proposed building height is 10% (2'/z feet) higher than permitted by Code (25 feet) and the lot size is less than 8% (581 square feet) smaller than required by Code for the proposed six bedroom house (7,550 square feet). 2. That no written opposition was received during the required 10-day notification period which ended on May 12, 2003; Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2003-00242, subject to the following conditions: That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2, 3 and 4, and as conditioned herein. ZA2003-017.doc - 1 of 2 - ZA2003-17 • That the petitioner shall obtain a building permit from the City of Anaheim for the proposed house addition within a period of one (1) year from the date of this decision. Extensions for further time to complete said condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
