OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal
and no correspondence was received in opposition.
REQUEST: Waiver of the following to construct an addition to the rear of an existing one-story
single-family residence in the RS-5000 (Residential, Single-Family) Zone:
Sections 18.12.060.070 - Maximum lot coverage.
and 18.27.062.030 (35°to permitted for dwelling units with 3-bedrooms
44% proposed)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I do hereby find:
1. That, including the proposed addition, usable outdoor recreational leisure space will be
available in the back yard (17+ feet) and the front yard (20+ feet), both of which exceed the minimum
Code requirements (5 feet and 10 feet respectively); and that the visual impact of the addition is minimal
because it is in the back yard and will not be visible to the street.
2. That strict application of the Zoning Code would deprive the property of privileges enjoyed
by other properties in identical zoning classification in the vicinity because similar waivers have been
approved for eight houses in the neighborhood, as discussed in paragraph (11) of the Staff Report to the
Zoning Administrator dated June 12, 2003.
Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No.
2003-04563, subject to the following conditions:
That the subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the
Planning Department marked Exhibit Nos. 1 (site plan and floor plan), 2 (lot coverage and area
study) and 3 (details of proposed addition and remodeling); and as conditioned herein.
That the proposed addition shall match the architectural design and materials of the existing single-
family residence; and that said information shall be specifically shown on the plans submitted for
building permits.
3. That within a period of one (1) year from the date of this decision, the appropriate permits shall be
obtained from the Building Division for the proposed house addition. Extensions for further time to
complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim
Municipal Code.

That approval of this application constitutes approval of the proposed request only to the extent that it
complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the
request regarding any other applicable ordinance, regulation or requirement.
This decision is made, signed, and entered into the file this 19th day of June, 2003.

by an appeal fee, is filed with the City Clerk within 15 davs of the date of the signing of this decision or
