ZA 2003-23 • A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2003-00245 REQUESTED BY: James Frize 867 South Blue Vista Circle Anaheim, CA 9 2808 LOCATION: 867 South Blue Vista Circle DATE NOTICES MAILED: June 13, 2003 REQUEST: Waiver of the following to construct an addition to an existing two-story single-family residence in Development Area 1 of Specific Plan No. 87-1 in the "(SC)" Scenic Corridor Zone Overlay: Sections 18.12.080.020 - Maximum structural height. 18.26.062.020.0201 (25 feet high permitted in the Scenic Corridor Zone 18.70.020.060 Overlay; 18.70.060.010 27% feet proposed) and 18.84.042.010 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That the proposal is located in Development Area 1 (Hillside Estate) of Specific Plan No. 87-1 (The Highlands); and that the detached single family residences in Development Area 1 are developed under the RS-7200 (Residential, Single-Family) Zone development standards with the exception of certain standards, including maximum structural height which is regulated by the Scenic Corridor Zone Overlay standards. 2. That height waivers are permitted in connection with administrative adjustments if the deviation from the Code requirement does not exceed 10% and if no written opposition is received during the required 10-day notification period; and that the request is hereby approved because the proposed building height is 27'/2 feet which is 10% (2% feet) higher than permitted for single-family dwellings in the Scenic Corridor Zone Overlay, and that no written opposition was received during the required 10-day notification period which ended on June 23, 2003. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2003-00245, subject to the following conditions: That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 4. That within a period of one (1) year from the date of this decision, a building permit shall be obtained from the City of Anaheim for the proposed addition. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and ZA2003-023.doc - 1 of 2 - ZA2003-23 • • Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
