ZA 2003-28 • A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2003-00248 REQUESTED BY: Noe Pena Little Diversified Architectural Consulting 1050 Lakes Drive, Suite 275 West Covina, CA 91790 OWNER: William Wade Bank First Security 700 South Orange Avenue West Covina, CA 91790 LOCATION: 1095 North Pullman Street DATE NOTICES MAILED: July 25, 2003 REQUEST: Waiver of the following to construct an outdoor garden addition to a proposed home improvement store in the CL(SC) (Commercial, Limited -Scenic Corridor Overlay) Zone: Sections 18.12.080.020 - Minimum number of parkin4 spaces. 18.06.050.020.022 (1,020 spaces required; 925 spaces proposed) and 18.44.066.050 DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080: 1. That waiver of the minimum number of parking spaces is permitted in connection with an administrative adjustment if the deviation from the Code requirement does not exceed 10% and if no opposition is received during a 10-day public notification period. 2. That the proposed waiver is 9.3% fewer parking spaces (95 spaces) than required for the proposed use and that no written opposition was received during the 10-day notification period which ended on August 4, 2003. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2003-00248 subject to the following conditions: That within a period of two (2) years from the date of this decision, subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 2. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
