REQUEST: Waiver of the following to construct a covered porch addition to asingle-family residence in the RS-7200(SC) (Residential, Single-Family -Scenic Corridor Overlay) Zone: Sections 18.12.060.050 - Minimum front yard setback. and 18.26.063.010 (25 feet required; 19 feet, 4 inches proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That strict application of the Zoning Code would deprive the property of privileges enjoyed by neighboring residences because the setback to the proposed porch addition is only one foot (about 0.5%) less than the existing 20-foot, 4-inch setback and that the proposed setback is consistent with houses on adjacent and nearby properties which have setbacks ranging from 15 feet to 20 feet; and that approval of this variance will not be detrimental the character and nature of the surrounding single family neighborhood. 2. That the applicant submitted a petition containing the signatures of 10 neighbors, who had seen the proposed plans, indicating that they had no objections to the porch addition. Based on the evidence and testimony presented to me, I do hereby approve Variance No. 2003-04572, subject to the following conditions: 1. That the subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1. 2. That prior to final building and zoning inspections or within a period of one (1) year from the date of this decision, whichever occurs first, Condition No. 1, above-mentioned, shall be complied with. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. ZA2003-033.doc - 1 of 2 - ZA2003-33 • • 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
