Resolution-ZA 2003-37 DECISION NO. ZA 2003-37 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE NO. 2003-04577 OWNER: Navin Parikh 227 North Sagamore Street Anaheim, CA 92807 LOCATION: 227 North Sagamore Street HEARING DATE: October 2, 2003 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal, and no correspondence in opposition was received. REQUEST: Waiver of the following to construct a family room, relocate a bedroom, and expand a master bedroom for a single family residence in the RS-5000(SC) (Residential, Single- Family -Scenic Corridor Overlay) Zone: Sections 18.12.060.070 - Maximum lot coverage. and 18.27.062.030 (35% permitted; 46% proposed) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That even with the proposed addition to the rear of the existing one-story residence, the proposed back yard setback (23 feet) will exceed the requirement (10 feet) and, therefore, adequate private outdoor space will be available; and that the proposed construction will not intrude on neighboring properties because it is only one-story high. 2. That another lot coverage variance has been granted in the neighborhood and, therefore, strict application of the Zoning Code would deprive this property of privileges enjoyed by other property under identical zoning classification in the vicinity. 3. That there is a special circumstance applicable to the property consisting of its size relative to the proposed addition because the resulting back yard setback exceeds the Code requirement and the one-story residence including the addition will not adversely impact adjoining and nearby properties; and that the proposed lot coverage is only 530 sq.ft. more than permitted by Code. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of maximum lot coverage to construct a family room, relocate a bedroom and expand a master bedroom for asingle-family residence in the RS-5000(SC) (Residential, Single-Family - Scenic Corridor Overlay) Zone on arectangularly-shaped 0.11-acre property having a frontage of 50 feet on the west side of Sagamore Street and a maximum depth of 100 feet, being located 450 feet north of the centerline of Addington Drive, and further described as 227 North Sagamore Street; and that the Planning Director's authorized representative has determined that the proposed project is Categorically Exempt (Class 5) under Section 15305 of the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 2003-04577, subject to the following conditions: za\decision\ZA2003-037.doc - 1 of 2 - ZA2003-37 • • That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2 and 3. 2. That prior to final building and zoning inspections or within a period of two (2) years from the date of this decision, whichever occurs first, Condition No. 1,above-mentioned, shall be complied with. Extensions for further time to complete said condition may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
