Resolution-ZA 2003-52• • DECISION NO. ZA 2003-52 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE NO. 2003-04588 OWNER; Corey M. Donaldson 1927 Harbor Boulevard, # 610 Costa Mesa, CA 93627 AGENT: Ron Martin 942 Calle Negocio, Suite 100 San Clemente, CA 92673 LOCATION: 1818 West Gramercy Avenue HEARING DATE: December 11, 2003 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: Waiver of the following to establish a 2-lot subdivision in the RM-1200 (Residential, Multiple Family) Zone for an existing 8-unit apartment complex: Sections 18.12.060.080 - Minimum lot width. and 18.34.061.020 (70 feet required; 51 feet proposed} Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That strict application of the Zoning Code would deprive the property of privileges enjoyed by other properties under identical zoning classification in the vicinity since the characteristics of the proposed subdivision to establish two separate multiple-family parcels would be compatible with the lot sizes and configurations of other properties in the immediate neighborhood which have similar lot size, shape and unit orientation; and further that the proposed lots, with the exception of lot width, comply with applicable zoning requirements including setbacks, density, lot area and coverage. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum lot width to establish a 2-lot subdivision in the RM-1200 (Residential, Multiple Family) Zone for an existing 8-unit apartment complex on arectangularly-shaped 0.25-acre property having a frontage of 103 feet on south side of Gramercy Avenue and a maximum depth of 108 feet, being located 240 feet east of the centerline of Chippewa Avenue, and further described as 1818 West Gramercy Avenue; and that the Planning Director or her authorized representative has determined that the proposed project is Categorically Exempt, Class 32, under Section 15061(b)(3) of the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 2003- 04588, subject to the following conditions: 1. That approval of this variance is granted specifically for the subdivision shown on Tentative Parcel Map No. 2003-235, now pending; and that this variance shall terminate if the final map is not approved and recorded. 2. That any necessary relocation of existing electrical facilities shall be at the expense of the property owner. ZA2003-052.doc - 1 of 2 - ZA2003-52 • 3. Proposed Condition No. 3 was intentionally deleted because it has been replaced with Condition No. 4 in Tentative Parcel Map No. 2003-235. 4. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1, and as conditioned herein. 5. That prior to commencement of the activity authorized by this decision (i.e., recordation of a final map in connection with Tentative Parcel Map No. 2003-235) or within a period of two (2} years from the date of this decision, whichever occurs first, Condition Nos. 1, 2 and 4, herein-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 (Time Limit for Amendments, Conditional Use Permits, Administrative Use Permits, Variances and Administrative Adjustments) of the Anaheim Municipal Code. 6. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
