Resolution-ZA 2003-53• i DECISION NO. ZA 2003-53 A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP NO. 2003-235 OWNER: Corey M. Donaldson 1927 Harbor Boulevard, # 610 Costa Mesa, CA 93627 AGENT: Ron Martin 942 Calle Negocio, Suite 100 San Clemente, CA 92673 LOCATION: 1818 West Gramercy Avenue HEARING DATE: December 11, 2003 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence in opposition was received. REQUEST: A tentative parcel map to establish a 2-lot subdivision in the RM-1200 (Residential, Multiple-Family) Zone for an existing 8-unit apartment complex. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: That the proposed subdivision map is consistent with Anaheim General Plan. 2. That the design or improvement of the proposed subdivision is consistent with the applicable General Plan designation of Low Density Residential land uses. 3. That the site is physically suitable for the type of development which exists on the property. 4. That the site is physically suitable for the proposed and existing density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Zoning Administrator has reviewed the proposal for waiver of minimum lot width to establish a 2-lot subdivision in the RM-1200 (Residential, Multiple Family) Zone for an existing 8-unit apartment complex on a rectangularly-shaped 0.25-acre property having a frontage of 103 feet on south side of Gramercy Avenue and a maximum depth of 108 feet, being located 240 feet east of the center{ine of Chippewa Avenue, and further described as 1818 West Gramercy Avenue; and that the Planning Director or her authorized representative has determined that the proposed project is Categorically Exempt, Glass 32, under Section 15061(b)(3) of the State of California Environmental Quality Act Guidelines. ZA2003-053.doc - 1 of 2 - ZA2003-53 • • Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 2003-235, subject to the following conditions: 1. That approval of this parcel map is granted subject to approval of Variance No. 2003-04558, now pending. 2. That a final map shall be submitted to and approved by the Anaheim City Engineer and the Orange County Surveyor, and shall then be recorded in the Office of the Orange County Recorder. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. 4. That prior to final map approval, a deed restriction shall be submitted to the Zoning Division and City Attorney for review and approval specifying that no fence, wall or other physics{ barrier shall be constructed along the interior property line separating Parcels 1 and 2 or within the yards between the two apartment buildings in order to preserve the open space between the buildings on each parcel. The approved deed restriction shall be recorded concurrently with the Final Map; and that following recordation at the Office of the Orange County Recorder, a copy of the recorded document shall be submitted to the Zoning Division.
