OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and
no correspondence was. received in opposition.
REQUEST: Waiver of the following to construct a room addition and garage expansion to the rear of
an existing single family residence in the RS-7200 (Residential, Single-Family) Zone:
(a} Sections 18.12.060.070 - Maximum rear yard coverage.
and 18.26.062.031 (35% of required rear yard permitted [= 525 sq.ft.];
42% proposed [= 630 sq.ft.])
(b) Sections 18.12.060.050 - Minimum side yard setback.
and 18.26.063.020 (5 feet required between the garage and the south
property fine; 3 feet existing)
Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, l do hereby find:
1. That waiver (a}, maximum rear yard coverage, is hereby approved on the basis that additional
outdoor space amounting to more than 500 sq.ft. exists and exceeds the 105 sq.ft. difference between the
permitted rear yard coverage (525 sq.ft.) and `tlie proposed coverage (630 sq.ft.).
2. That waiver (b), minimum side yard setback, is hereby approved because the existing detached
garage is located 3 feet from the south property line in compliance with zoning requirements for detached
accessory structures but as a result of the proposed addition (which will connect the house to the existing
garage) the required setback between the future attached garage is increased to 5 feet; and that waiver
(b) is an existing condition which is not being increased or intensified as a result of the proposed addition.
3. That the proposed addition wilt not have an adverse impact on neighboring properties because
the addition is only one-story high and a 14-foot setback from the centerline of the alley will be maintained
in accordance with Zoning Code requirements.
4. That construction of the third garage space and an additional uncovered space will bring the
property into compliance with the parking standards for this single-family residential home (i.e., 4 spaces).
Based on the evidence and testimony presenfetl tome, I do hereby determine to approve Variance No.
2004-04606, subject to the following conditions`.

1. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitionerand which plans are on file with the Planning
Department marked Exhibit Nos. 1, 2 and 3, as conditioned herein.
2. That within a period of two (2) years from the date of this Decision, Condition No. 1, above-mentioned,
shall be complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 (Time Limit for Amendments, Conditional Use Permits,
Administrative Use Permits, Variances and Administrative Adjustments) of the Anaheim Municipal
Code.
3. That the remaining open area in the yard between the house and the alley shall be retained such that
at least nine hundred seventy five (975) sq.ft. is maintained for usable open recreational leisure space
(based on the required rear yard for this property being 1,500 sq.ft. in size, the permitted rear yard
coverage being 35% or 525 sq.ft. and, therefore, the minimum required open space is 65% or 975
sq.ft.).
4. That the property shall be permanently maintained in an orderly fashion through the provision of
regular landscaping and building maintenance and the removal of trash or debris.
5. That approval of this application constitutes approval of the proposed request only to the extent that it
complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal
regulations. Approval does not include; any action or findings as to compliance or approval of the
request regarding any other applicakile ordinance, regulation or requirement.

NOTICE: This decision shall become final unless an appeal to the City Council, in writing, accompanied
by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or
unless members of the City Council shall request to review this decision within said 15 days.
