ZA 2004-17 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT N0.2004-00267 REQUESTED BY: Gustavo Esquivias 2672 West Stonybrook Drive Anaheim, CA 92804 LOCATION: 2672 West Stonybrook Drive DATE NOTICES MAILED: May 14,2004 REQUEST: Waiver of the following to construct a 2-story addition to an existing single-family residence in the RS-7200 (Residential, Single Family) Zone: Sections 18.12.080.010.0101 Minimum front yard setback. and 18.26.063.010 {25 feet required; 21 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.12.080 (Administrative Adjustments): 1. That the request is hereby granted in accordance with subsection 18.12.080.010.0101 of the Anaheim Municipal Code which permits waiver of the required minimum front yard setback in connection with an administrative adjustment if the deviation from the Code requirement does not exceed 20% and if no opposition is received during the required 10-day notification period; and 2. That the proposed deviation (4 feet} is 16% of the Code requirement and no written opposition was received during the 10-day notification period which ended on Monday, May 24, 2004. Based on the evidence presented to me, 1 do hereby determine to grant Administrative Adjustment No. 2004-00267; subject to the following conditions: 1. That the appropriate permits shall be obtained from the Building Division for the proposed addition. 2. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 1, 2 and 3. 3. That within a period of two (2) years from the date of this Decision,-the final building inspection shall have been conducted and/or the certificate of occupancy shall have been issued for the proposed addition. Extensions for further time to complete this condition may be granted in accordance with Section 18.03.090 (Time Limit for Amendments, Conditional Use Permits, Administrative Use Permits, Variances and Administrative Adjustments) of the Anaheim Municipal Code. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code, except as otherwise approved herein, and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
