ZA 2004-28 A DECISION OF THE ZONING ADMINISTRATOR APPROVING VARIANCE N0.2004-04621 OWNER: William Glen 1140 West South Street Anaheim, CA 92802 LOCATION: 1140 West South Street CEQA STATUS: CEQA Categorical Exemption -Class 1 HEARING DATE: August 19, 2004 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence was received in opposition. REQUEST: Waiver of the Following to install a laundry facility in the existing garage of a single family residence: Sections 18.04.110 - Minimum dimensions of off-street oarkinc spaces. 18.42.030.010.0104 (Minimum interior garage dimensions: 20 feel by 20 feet; and 18.74.060.020 Proposed dimensions: 17 feet-10 inches by 16 feet) Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.74.040 (Approval Authority), to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1, That this variance is approved because the proposed laundry facility will consist of laundry appliances with appropriate plumbing fixtures and lines, and there will be no permanent building improvements that would prohibit future use of the garage for parking two vehicles, in compliance with Code., if the laundry appliances were removed; and that the petitioner indicated that in addition to the two tandem parking spaces in front of the garage, there is space for additional on-site parking if needed. 2. That strict application of the Zoning Code would deprive the property of privileges enjoyed by other properties in the identical zoning classification in the vicinity because other residents have Installed similar laundry facilities in their garages thereby reducing the interior dimensions of the garages and the space available for parking two vehicles. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 2004-04621, subject to the following conditions: 1, That subject property shall be developed substantially in accordance with the plarnsubmitted to the City of Anaheim by the petitioner and which plan is on file with the Planning Department marked Exhibit No. 1. That within a period of one (1) year from the date of this Decision, (1) the appropriate permit(s) shall have been obtained from the Building Division for the proposed improvements inside the garage and (2) a dimensioned plan shall be submitted to the Planning Department (to be filed with this Variance) showing that one (1) additional open parking space can be provided on the properly adjacent to the driveway if needed. The minimum width of an open parking space is eight and one- halF (8'/) feet wide and the minimum depth is eighteen (18) feet, except that the minimum depth shall be twenty five (25) feet if the open space is in tandem to atilt-up garage door, or twenty (20) feet if the space is in tandem to a roll-up garage door. Extensions for further time to complete this ZA2004-028:doc - 1 oft - ZA2004-2$ condition may be granted in accordance with Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of the Anaheim Municipal Code. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
