VARIANCE NO. 2002-04544 -Request for a second 1-year time extension to comply with the conditions of approval LOCATION:. 1127 Pointe Premier - 5.8 acres having a frontage of 233 feet on the west side of Pointe Premier and a maximum depth of 791 feet, and being located 287 feet south of the centerline of Avenida de Santiago. www.anaheim.net At the meeting of December 23,.2004, Annika M. Santalahti, Zoning Administrator, considered your request for a second one (1)-year time extension for Variance No. 2002-04544 (to expire on February 13, 2006) to comply with the conditions of approval Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) to decide this request, Ms. Santalahti made the following findings: 1. That Variance No. 2002-04544 was approved on February 13, 2003 for waiver of maximum structural height to construct a 3-story single-family residence in the RH-2(SC) (Single-Family Hillside, Residential -Scenic Corridor Overlay) Zone; and on August 3; 2004 a 1-year retroactive extension of time (from February 13, 2004 until February 13, 2005) was granted to comply with the conditions of approval 2. That this request for a second time extension will not extend the approval beyond two extensions, with each extension not to exceed one year, as permitted by the` Zoning Code. 3. That the approved project remains consistent with the Anaheim General Plan and the zoning designation for the property. 4. That no code amendments have occurred since this project was approved that would cause the original approval to be inconsistent with the Zoning Code. 5. That the subject property is being maintained in a safe, clean and aesthetically pleasing condition with no unremediated code violations, as confirmed by an inspection of the subject property by the Code Enforcement Division. 6. That no additional information or changed circumstances are present which would contradict the facts necessary to support one or more of the required findings for the original approval of this project. ACTION: In connection with the original approval of this variance, it was determined that the project was Categorically Exempt under Section 15303, Class 3 (New Construction or Conversion of Small Structures) of the California Environmental Quality Act Guidelines; and the Zoning Administrator has, therefore; determined that this request for a time extension is also Categorically exempt. This decision shall become final unless an appeal to the City Council, in writing, accompanied by the appropriate appeal fee, is filed with the City Clerk within fifteen (15) from the date of this letter, or unless members of the City Council request a review of this decision within twelve (12) days from the date of this letter.
