ZA 2005-05 A DECISION OF THE ZONING ADMINISTRATOR APPROVING TENTATIVE PARCEL MAP NO. 2004-318 OWNER: Elisa Stipkovich Anaheim Redevelopment Agency 201 South Anaheim Blvd. Anaheim, CA 92805 AGENT: Huitt-Zollars 430 Exchange Suite 200 Irvine, CA 92602 Attention: John Duquette LOCATION: 802-808 East Broadway 801 East Santa Ana Street, and 409-421 South Vine Street. Property consisting of 2.3 acres located on the west side of Vine Street between Broadway and Santa Ana Street, and having frontages of 128 feet on the south side of Broadway, 820 feet on the west side of Vine Street and 125 feet on the north side of Santa Ana Street. CEQA STATUS: CEQA Categorical Exemption-Class 15 PUBLIC HEARING DATE: March 17, 2005 OPPOSITION: No one indicated their presence at the public hearing in opposition to the proposal and no correspondence was received in opposition. REQUEST: Approval of a tentative parcel map to combine seventeen (17) parcels into to one (1) parcel to construct an affordable apartment complex in the RM-4 (Multiple-Family Residential) Zone. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.60.020 (Establishment of Zoning Administrator Position), to decide the above- referenced petition and a public hearing having been duly noticed for and held on the date set forth above, 1 do hereby find: 1. That the proposed subdivision is consistent with the Anaheim General Plan, which designates this site for Medium Density Residential land uses; and that the site is suitable for construction of an apartment complex in conformance with the applicable zoning and development standards. Plan. 2. That the design and/or improvement of the proposed subdivision is consistent with General 3. That the design of the proposed subdivision, or the proposed improvements, are not likely to cause substantial environmental damage or to substantially and avoidably injure fish or wildlife or their habitat; 4. That the design of the proposed subdivision, or the type of improvements, are not likely to cause serious public health problems. 5. That the design of the proposed subdivision, or the type of improvements, will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. That during the public hearing, staff indicated that the existing right-of-way on Santa Ana Street was 34.75 feet; but that the General Plan designates it as a local street and the City standard details call fora 30-foot right-of-way; and that the applicant may request an abandonment through the Public Works Department of 4.75 feet to establish the right-of-way at 30 feet. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS: That the Planning Director or the Planning Director's authorized representative has determined that the proposed project is Categorically Exempt, Class 15 (Minor Land Divisions), under Section 15315 of the State of California Environmental Quality Act Guidelines. Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No.2004-318, subject to the following conditions: That the legal property owner of the subject property shall provide the City of Anaheim with a public utilities easement along/across high and low voltage lines crossing private property and around all pad-mounted transformers, switches, capacitors, etc. Said easement shall be submitted to the City of Anaheim prior to connection of electrical service. 2. That the property shall be served with underground utilities in conformance with the electrical rates, rules and regulations (the most current fees shall apply), and the City of Anaheim Underground Policy. Special exceptions to the Cit~ls under-grounding policy may be granted, subject to approval by the General Manager of the Public Utilities Department and/or the City Council. 3. That prior to final parcel map approval, the appropriate street addresses shall be assigned by the Building Division. 4. That all requests for new water service or fire lines, as well as any modifications, or abandonments of existing water services and fire lines, shall be coordinated through the Water Engineering Division, Public Utilities Department. 5. That all existing water services and fire lines shall conform to current Water Services Standard Specifications. Any water service and/or fire line that does not meet current standards shall be upgraded if continued use is necessary or abandoned if the existing service is no longer needed. The owner/developer shall be responsible for the costs to upgrade, or to abandon, any water service or fire line. 6. That the legal property owner shall irrevocably offer to dedicate to the City of Anaheim an easement for water service mains and/or an easement for large meters, backflow devices and other public water facilities to the satisfaction of the Water Engineering Division, Public Utilities Department. 7. That an improvement certificate shall be placed on the final parcel map to indicate that all street improvements required by the Planned Roadway Network Map and applicable Public Works Standard Details shall be constructed prior to certificates of occupancy being issued in connection with future building and development permits. 8. That the property owner shall irrevocably offer to dedicate to the City of Anaheim, on the final parcel map, an easement forty-five (45) feet in width (five (5) feet additional dedication from the existing right-of-way) from the construction centerline of the street along Broadway for road, public utilities, and other public purposes. Corner cut-off dedication shall also be required on Vine Street at the intersections with Broadway and Santa Ana Street. 9. That all existing structures shall be demolished. That prior to final parcel map approval, the final map shall be submitted to, and approved by, the Orange County Surveyor; following city approval of the final parcel map, it shall be recorded in the Office of the Orange County Recorder. 11. That prior to final parcel map approval, Condition Nos. 3, 7 and 8, above-mentioned, shall be complied with. 12. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
