Resolution-ZA 2005-11• DECISION NO. ZA 2005-11 A DECISION OF THE ZONING ADMINISTRATOR GRANTING ADMINISTRATIVE ADJUSTMENT NO. 2005-00274 REQUESTED BY: Kirk G. Property consisting of 7,500 square feet with a frontage of 75 feet on the south side of Briarvale Avenue and located 131 feet east of the centerline of Whittier Street. DATE NOTICES MAILED: April 29, 2005 CEQA STATUS: Categorically Exempt, Class 1 REQUEST: Waiver of the following to construct a 2"d story addition to an existing attached garage for asingle-family residence in the RS-2 (Single-Family Residential) zone. Sections 18.04.100.010.0101 - Minimum front yard setback. and 18.62.040.020.0201 (25 feet required; 20 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.62.040 (Administrative Adjustments) of the Anaheim Municipal Code: 1. That the applicant submitted photographs of other houses in the neighborhood with second stories built over garages where the setback from the public street was less than 25 feet, similar to the proposal. 2. That the request is hereby granted in accordance with subsection 18.62.040.020 (Types of Adjustments) of the Anaheim Municipal Code, which permits waivers of minimum front yard setback in connection with administrative adjustments when the maximum deviation from the Code requirement does not exceed 20% (the proposed deviation is 20%) and when no written opposition is received. 3. That no written opposition was received during the required 10-day notification period, which ended on Monday, May 9, 2005. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2005-00274, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1, 2, 3 and 4. 2. That within a period of one (1) year from the date of this Decision, the applicant shall obtain the appropriate permits from the City of Anaheim for the approved house addition. Extensions for further time to complete this condition may be granted in accordance with Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of the Anaheim Municipal Code. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
