DATE NOTICES MAILED: May 12, 2005 REQUEST: Waiver of the following to construct an enclosed patio to the rear of asingle-family home in the RS-3(SC) (Single Family Residential -Scenic Corridor Overlay) zone: Sections 18.04.100.010.0101 - Minimum rear yard setback. and 18.62.040.020.0201 (15 feet required; 12 feet proposed) DETERMINATION OF THE ZONING ADMINISTRATOR Having been appointed Zoning Administrator by the Planning Director to decide the above-referenced Administrative Adjustment, and subject petition having been duly noticed and no written objections having been received, I do hereby find, pursuant to Section 18.62.040 (Administrative Adjustments) of the Anaheim Municipal Code: 1. That the request is hereby granted in accordance with paragraph .0201 of subsection 18.62.040.020 (Types of Adjustments), which permits waiver of minimum rear yard setback in connection with an administrative adjustment if (i) the deviation from the Zoning Code requirement does not exceed 20% and (ii) no written opposition is received during a 10-day notification period. 2. That the proposed deviation (3 feet) is 20% less than the minimum Code requirement and no written opposition was received during the 10-day notification period, which ended on May 23, 2005, at 5:00 p.m. Based on the evidence presented to me, I do hereby determine to grant Administrative Adjustment No. 2005-00275, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit Nos. 1 and 2. 2. That within a period of one (1) year from the date of this decision, the appropriate permits shall be obtained for the approved patio enclosure. Extensions for further time to complete this condition may be granted in accordance with Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of the Anaheim Municipal Code. 3. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
