Kaiser Blvd. Anaheim, CA 92808 LOCATION: 1041 North Shepard Street CEQA STATUS: CEQA Negative Declaration PUBLIC HEARING DATE: September 15, 2005, continued to September 29, 2005 OPPOSITION: No one indicated their presence at the public hearing in opposition and no correspondence was received in opposition. REQUEST: Approval of a tentative parcel map to establish an 8-lot, 22-unit airspace, industrial subdivision in Development Area 3 (La Palma Core Area) of the Northeast Area Specific Plan No. 94-1, under authority of subsection 18.60.020.030 (Tentative Parcel Maps) of the Anaheim Municipal Code. Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal Code Section 18.60.020 (Establishment of Zoning Administrator Position), to decide the above- referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find: 1. That this tentative map was re-advertised in order to be considered in conjunction with Variance No. 2005-04667 for waiver of the Zoning Code requirement that all lots have frontage on a public or private street. 2. That the proposed map is consistent with the applicable General and Specific Plans. 3. That the design and/or improvements of the proposed subdivision are consistent with applicable General and Specific Plans. 4. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or to substantially and avoidably injure fish or wildlife or their habitat. 5. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. 6. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. h:\tools\ZA2005-19 TPM2005-201.doc - 1 of 3 - ZA2005-19 • Based on the evidence and testimony presented to me, I do hereby determine to approve Tentative Parcel Map No. 2005-201, subject to the following conditions: That a final map to record the subdivision of subject property shall be submitted to and approved by the City of Anaheim and the Orange County Surveyor. Following approval, the final parcel map shall be recorded in the Office of the Orange County Recorder prior to issuance of a building permit. 2. That a maintenance covenant shall be submitted to the Subdivision Section and approved by the City Attorney's office. The covenant shall include provisions for maintenance of private facilities, including compliance with approved Water Quality Management Plan, and a maintenance exhibit. The covenant shall be recorded concurrently with the final map. 3. That the legal property owner shall execute a Subdivision Agreement, in a form approved by the City Attorney, to complete the required public improvements at the legal property owner's expense. Said agreement shall be submitted to the Public Works Department, Subdivision Section, for approval by the City Attorney and City Engineer, and then be recorded concurrently with the final parcel map. 4. That prior to any existing structures being demolished or remodeled to conform with building and zoning setback requirements. The developer shall obtain the appropriate demolition permit(s) and/or building permit(s) from the Building Division. That all buildings shall be assigned street addresses by the Building Division. Street names for any new public or private street (if requested by the developer or required by the City) shall be submitted to and approved by the Building Division. That an unsubordinated restricted covenant providing reciprocal access and parking, in a form satisfactory to the City Attorney, shall be submitted to the Planning Services Division for review and approval, and that following approval said covenant shall be recorded with the Office of the Orange County Recorder. A copy of the recorded covenant shall then be submitted to the Planning Services Division. In addition, provisions shall be made in the covenant to guarantee that the entire complex shall be managed and maintained as one (1) integral parcel for purposes of parking, vehicular circulation, signage, maintenance, land usage and architectural control, and that the covenant shall be referenced in all deeds transferring all or any part of the interest in the property. That Variance No. 2005-04667, which was considered in conjunction with this tentative map, shall be approved. That approval of this application constitutes approval of the proposed request only to the extent that is complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal Regulations.
