CITY ATTORNEY~ Preston Turner, Present~ CITY ADMINISTRATIVE OFFICER~ Keith Ao 'Murdoch9 Present~ VARIANCE NO. 552: At the request of tije adjacent pr6perty owners, public hearing was held August 28, 1956 on the possib~lity of revoking Variance NOe 552, which was previously granted by the City Plannin9 Comadssiono Said hearing was declared closed and the City Council requested a legal opinion from the City Attorney be- fore taking any action on the mattero ~ The legal opinion of the City Attorney was submitted and read in ful19 wherein Mro Turner advised that it was:his opinion that the reports and evidence presented to the City Council at the lctst me.eti-ngshowedtitat the Applicant has made substantial progress toward the aqcomplishment of the purpose of the varianceo There being no evidence before the City Council showing that the Variance had been violated in any respect~ it was his op~nion that the City Council was precluded from revoking said permit at this tirneo Further discussion was held ltelative to a buffer strip or the relocation of the buildings and parking areao Mayor Pearson felt that some sort of screening should be made by the construction ofa wall and the planting of trees to protect the residents to the southe The group then adjourned to the offi ce of the Ci ty Ensineer wi th the Secretary of the City Planning Commisslon to endeavor to work out a suitable solution regarding the possibility of the buffer stripo On their return, Mro Mungall~eported that no amicable arrangement had been met, that Mro Wells was agreeable to the planting of the trees~ however the group wanted an earth wall ten feet high as a buffero i'~ After further discussion the City Council determined that the request for the earth wall as a buffer was unr~asonable~ however~ it was their opinion that the wall as originally imposed by the Variance permit granted by the City Planning Commission, was for the protection of the adjacent property owners, and should be at least six feet above the highest ground level with the additional screening provided by the planting of treeso Mro Wells agreed to try to work out a partial financial reimbursement of the cost on those fences already erected that could be utilized in the compliance of his Variance permito Mro Wells agreed that the conditions imposed by the City Planning Commis'sion's Resolution be modified to include the stipulation that the fence be at least six feet above the highest ground level and further, that trees be planted along the south wall to complete the buffer stripo RESOLUTION NOo 3453; Councilman Coons offered Resolution Noo 3453 and moved for its passage and adoptiona Refer to Resolution Book, page A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING THE REOOEST OF PROPERTY OWNERS FOR RELOCATION OF VARI~.rcE 000 552 AND APmOVING THE VARIANCE AS GRANTED BY THE CTTYPLAMNIt<<; <ntIMIS ,ON -AJID SUBJECT, TO THE FURTHER CONDITION THAT APPLICANT PLANT TREES ALONG THE S(lJTHERLY BOUNDARY OF THE PROPERTY. The Mayor declared the foregoing resolution duly passed and adopted. ~ APPLICATION FeR A TAXI CAB PERMIT: Application of Mr" Frank Miller for pennission to establish a taxi cab business within the City of Anaheim was brought up. Com- munication from Mr. Claud C. Stalians, operator of the Yellow Cab Company in Fullerton" was submitted and read, wherein he stated it was his opinion that Anaheim was being served very well at the present timee The Administrative Officer reported that a survey had been made to determine the necessity of granting addltional permits and it was found that there are presently 18 permits issued with a maximum use during peak periods of 12. As' to the type of service rendered, a check with some of the individuals riding in cabs was made and it was found that there are no major complaints to the quality of servi ce. Councilman Coons moved that the application of Mr. Frank Miller for permission to establish a taxi cab business in the City of Anaheim be denied in view of the fact that the present set1rice is adequate and further, sufficient permits are issued at the present time to take care of the requirements. Councilman Schutte seconded the motion. MOTION CARRIED. Mr. Murdoch felt that inasmuch as necessity has to be found for a new cab service there should be some means to determine if the requirements are being met and the City Council should be able to force complete service at any time by either notification to the company of the fact and allowing them an opportunity to establish additional facilities, or by calling for bidsto provide the needed additional service to the public. l It was the opInion of the City Council that Mr. Murdoch's suggestion should be investigated further as it had definite merit. CLAIM FOR DAMAGES: Verified claim submitted by Olga Ballinger for injuries sustaIned resulting from fall on the sidewalk on EMily Street south of Adele Street, was submi tted and ordered denied by the Ci ty Council on motion by Councilman Wisser, seconded by Councilman Fry. MOTION CARRIED. LIBRARY AT NEW CIVIC CENTER SITE: The City Attorney advised that additional time was needed for the working out of a method by which the Library Board can be assured a future si te on the Ci vi c Center Property prior to the reimbursement of their proportionate share of the purchase price of said site. AMBULANCE SERVICE WITHIN THE CITY OF ANAHEIMl The Administrative Officer reported with reference to the request received from Virgil E. Sullivan and Roy P. Blecher for a perm! t to operate an emergency ambulance seni ces wi thin thi s Ci ty, and that according to the Anaheim Municipal Code they can establish a business by simply taking out a required business license and paying the required fee. With reference to the Crane Ambulance Service, Mr. Murdoch requested that additional time be allowed for him to make further investigations prepartory to recommendations. BUlLDING PLANS - MR. CROSBY: The proposed plans for the improvement of the north- west corner of North Palm Street and La Palma Avenue were submitted and ordered referred to the City Planning Commission for checking and recommendation. l J REQUEST - BUSINESS LICENSE: Request of Lester Valenzuela for permission to pick up and sell old newspapers and rags and other discarded items within the City of Anaheim was brought up. The Administrative Officer reported that the method Mr~ Valenzuela in- tended to use in the picking up of these items is to insert an ad in the newspaper and pOSsibly through contact with the people he is doing business with, to pick up 1665 City Hall. He requested a waiver of the mormal $25000 license feeo Mro Murdoch furtheT advised that he did not intencl to store any of the items as they are -to be sold the same day or as soon as pO$sible, and that this service is presently extended by the Salvation Army and other similiar organizationse MrQ Murdoch reported that the necessary $25.00 fee required by the State Board of Equalization has been waived in the case of Mra Valenzuela, due to the fact that he is an Disabled Veteran under the care of the Bureau of Vocational Rehabilitation.. Councilman Schutte moved that the City Council waive the $25.00 license fee required and grant Mr~ Valenzuela permission to operate this business as long as this business is operated in the proper manner9 due to the fact that he is an Disabled Veteran and under the care of the Bureau of Vocational RehabilitatlonG Councilman Wisser seconded the motion. With reference to the request of MrD White for permission to lease certain city owned property for oil and gas~ the City Attorney reported that the City of Anaheim could not enter into the fom of oil lease as was submitted to him for checking because of the pooling agreement and other clauses of the lease~ and that in its present formj it is contrary to the re- quirements the City must meet in leasing City owned propertyo ~ The City Council declined to take any action on this matter at this time and informed Mro White that they would discuss this issue with him at a meeting to be held Thursday.
