The City Council of the City of Anaheim met in adjourned regular PRESENT: ABSENT: PRESENT: COUNCILMEN: Coons, Fry, Pearson and Schutte. COUNCILMEN: Borden. CITY MANAGER: Keith A. Murdoch. ASSISTANT CITY ATTORNEY: Joseph Geisler. CITY CLERK: Dene M. Williams. CITY ENGINEER: Thornton Piersall. CITY PLANNING DIRECTOR: Robert W. Mungall. Mayor Schutte called the meeting to order. EBOPOSED R-3 STANDARDS: The City Clerk read in full the proposed R-3 standards, Sections 9200.R3-1 to 9200.R3-13, inclusive. Discussion was held by the City Council, and on motion by Councilman Pearson, seconded by Councilman Coons, the proposed R-3 Standards, as read by the Ci.ty Clerk, were referred to the City Planning Commission for necessary consideration preparatory to their recommendations, with the recommendations that Section 9200.R3-6 be amended to read, "One hundred and fifty (1501) feet from the R3 Zone boundary, inclusive of streets and alleys."; and, that further consideration be given Section 9200.R3-8, A. 1., relative to front yard set back requirements, and also Section 9200.R3-12 A, regarding the minimum parking requirements per dwelling unit. F-59-60-3: Submi tted by Keystone Savings and Loan Association, requesting change of zone from R-A to R-3, property located on the east side of Citron Street, between South Street and Vermont Avenue, and further described as Tentative Tract No. 3492. Public hearing was held on said reclassification August 18, 1959 and continued to this date, and again. continued for four weeks (September 29, 1959) to allow time for further consideration of the proposed R-3 Standards of development, on motion by Councilman Pearson, seconded by Councilman Coons. F-58-59-104: Submitted by Joseph D. Kopsho, Jr., re- questing C-l, R-2 and R-3 zoning on property located on the east side of Euclid Avenue between La Palma and Crescent Avenues (Tract No. 3372). Public hearing was held on said reclassification August 18, 1959, for the purpose of considering the elimination of Condition No.4 of Resolution No. 5366, at which time said hearing was closed and action by the City Council deferred to this date. Action by the City Council on said reclassification.as again deferred for a period of four weeks (Seotember 29. 1959) to allow time for further consideration of the proposed R-3 Standards of development, on motion by Councilman Pearson, seconded by Councilman Coons. F~59-60-9: Submitted by Valjacarl, Inc., requesting change of zone from R-l to R-3, Lots 20 and 21 of Tract No. 2114, located, briefly, north of Juno Avenue, west of Loara Street, at the end of Arden Place. MOTION CARRIED. PUBLIC HEARING -_ RECLASSIFICATION NO. F-58-59-105: Submitted by Emil A. and Louise Fischbeck, and Harold~aase, requesting change of zone from R-A to C-l, property located at 318 and 404 North Placentia Avenue (east side of Placentia Avenue, north of Anaheim-Olive Road). The City Planning Commission, pursuant to their Resolution No. 22, Series 1959-60, recommended said reclassification for a depth of 220 feet from the center line of Placentia Avenue, in accordance with Plan No.1, subject to: 1. The filing of Standard C-l deed restrictions of the City of Anahim, approved by the City Attorney. 2. The dedication to the City of Anaheim of 53 feet from the center line of Placentia Avenue. 3. Prepare street improvement plans and install all improvements in accordance with standard approved plans on file in the office of the City Engineer. 4. PaYment of $2.00 per front foot for street lighting purposes. 5. Extend 20 foot alley northerly along westerly line of property and westerly to Placentia Avenue. 6. That a 90 day time limit be set for the accomplishment of the above conditions. The Mayor asked if anyone wished to address the Council. Mr. Spehar, Authorized Agent, addressed the Council, urging the granting of said rezoning, and outlined on Plan No. 1 the area proposed for C-l uses, and advised that they proposed heighborhood commercial stores, however, had no prepared plans of development. Mrs. Doris Renfroe, 2017 Blanchard Avenue, addressed the Council in opposition to said rezoning, and advised that her property bordered a portion of the proposed C-l property on the south, and objected to the proposed alley along only a portion of her north property line, and requested to see plans of development. Others addressing the Council requesting information regarding the type of development and the location of the alley, were: Mrs. Marilyn Chase, 227 Curtis Way; Mrs. Edith Priske, 2133 Blanchard Avenue; and Mr. R. D. Shartle, 2105 Blanchard Avenue. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing clmsed. Councilman Pearson seconded the motion. MOTION CARRIED. PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-6: Submitted by Ora E. and Evelyn L. Hardacre, et aI, requesting change of zone from R-l to C-l, property located on the east side of Magnolia Avenue, between La Palma and Crescent Avenues. The City Planning Commission, pursuant to their Resolution No. 18, Series 1959-60, recommended said reclassification be denied. The Mayor asked if anyone wished to address the Council. Mr. Ora Hardacre, 1012 Magnolia Avenue; Mr. Gil Rodgers, 924 Magnolia Avenue; Mr. Martin Sorkin, presently operating an accounting office at lOl6 Magnolia Avenue under a Variance; Mr. Matt Lanza, 930 Magnolia Avenue, Applicants, addressed the Council, urging the granting of said rezoning requ~t, and outlined the existing commercial developments in the area and in their opinion, because of the heavy traffic on Magnolia Avenue, the area was no longer suitable for residential purposes. Mr. Hardacre advised that at the present time, they do not plan to change the exterior appearance of the dwellings. / It was noted that some of the intended uses, as listed in the rezoning application, were: Accounting Office, small tool sales office, beauty shop, real estate office and related business, drafting and small job printing sales office. Mr. Harold Hillen, 917 North Magnolia ftvenue, across the street from tre proposed C-l, addressed the Council in opposition to said request, and advised, that in his opinion, to grant this request would cause a residential area to become a neighborhood of signs. The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Further discussion was held by the City Council and it was their general opinion and if further consideration was again requested, that each individual request should be in the form of a variance application. RESOLUTION NO. 5462:_ Councilman Coons offered Resolution No. 5462 and moved for its passage and adoption, denying Reclassification Application No. F-59-60-6. RESOLUTION NO. 5464: Councilman Pearson offered Resolution No. 5464 and moved for its passage and adoption, authorizing the preparation of necessary ordinance, changing the zone as requested, subject to the recommendations of the City Planning Commission and further subject to the filing of standard C-l deed restrictions. PUBLIC HEARING - SPECIAL USE PERMIT NO. 45: Submitted by the Central Church of Christ, requesting permission to add class rooms and a larger auditorium on property located at 1590 West Ball Road (south side of Ball Road between Euclid Avenue and Walnut Street). The City Planning Commission, pursuant to their Resolution No. 27, Series 1959-60, granted said special use permit, subject to: 1. That the City Council set this Special Use Permit No. 45 for review in order that the Church present plans and elevations of proposed additions. 2. That a dedication to the City of Anaheim of 53 feet be made from the centerline of Ball Road. 3. Prepare street improvement plans and install all improvements in accordance with standard approved plans on file in the office of the City Engineer. 4. Review of action taken by the City Planning Commission was ordered by the City Council and public hearing scheduled to be held this date. The Mayor asked if anyone wished to address the Council. Mr. Dixon, Minister of the Central Church of Christ, ~dressed the Council, advising that the plans were not yet ready to be presented and requested a con- tinuance of said public hearing for an additional 60 days. Based on the Applicant's request, Councilman Coons moved that public hearing on Special Use Permit No. 45 be continued to November 3, 1959, 7:00 P.M. Councilman Fry seconded the motion. The Mayor asked if anyone wished to address the Council. There was no response. Mr. Geisler advised that the new overhang easement has not yet been signed ~nd recommended that said public hearing be continued. The Mayor asked if anyone wished to address the Council, there being no response arid no written protests filed in the office of the City Clerk, declared the hearing closed. Discussion was held by the City Council and Councilman Coons and Councilman Fry felt that the building permit fee schedule established in the 1958 Building Code was excessive. JENTATIVE MAP - TRACT NO. 3501: Subdivider, Standard Development Company. Tract located on the south side of Ball Road, approximately 630 feet west of Knott Avenue, and contains 250 R-l lots. The City Planning Commission disapproved said Tentative Map, Tract No. 3501. At the request of the Developer, action by the City Council on said map was deferred from the meeting of August 25, 1959. Communication dated August 18, 1959, from Harvey P. Shunk requesting a fence for the protection of his property and chicken business, was submitted. Mr. Piersall explained the location of the tract and various engineering requirements relative to street extensions and drainage faCilitieS4 Smeltzer, . Mr. Ne~seH, Superintendent of the Savanna School District, addressed ~ the Council with reference to the proposed school site adjacent to this tract on the south. Councilman Fry moved that Tentative Map, Tract No. 3501, be approved, subject to Engineering Committee recommendations, and in addition, subject to the presentation of plans prior to approval of the final map. Councilman Schutte seconded the motion. MOTION CARRIED. Mr. Shunk addressed the Council relative to his request for a seven foot fence from the subdivider's lot level for the protection of all concerned. Councilman Fry moved that the motion approving said tentative map, Tract No. 3501, be modified to include as part of the approval, a six foot masonry wall from the subdividerQs new lot level, along the north line of the Shunk property for a distance of approximately 344 feet. Councilman Pearson seconded the motion. MOTION CARRIED. WAIVER OF SIDEWALK REQUIREMENTS: Request dated August 26, 1959 from Oltmans Construction Company, requesting waiver of sidewalk requirement in their application for a permit for a driveway at 297 Crescent Way, Anaheim., was submitted. On the recommendations of the City Engineer, said request for a waiver of sidewalk requirement at 297 Crescent Way, Anaheim, was granted, on motion by Councilman Coons, seconded by Councilman Pearson. MOTION CARRIED. _~AIVER OF CURB~ GUTTERS AND SIDEWALK REQUIREMENTS: Communication dated August 24, 1959, from James L. Murray, requesting waiver of curbs, gutters and sidewalk requirements at 8211 Brookhurst Street, until such time as like improvements are required in the area, was submitted. On the recommendations of the City Engineer and City Manager, Councilman Fry moved that said request be granted, in conformance with Mr. Murray's letter dated August 24, 1959. MOTION CARRIED. RECLA~~IEICATION NO. F-56-57-42: Request dated August 26, 1959 from Mrs. Angelo J. Scaglione, requesting the removal of Condition No.1 of Resolution No. 3783 (same as Condition No.1 of Ordinance No. 1157) to allow for proposed residential development, was submitted. The plans in the file were again reviewed by the City Council. Mr. Scaglione addressed the Council and explained the circumstances of his request. Councilman Coons moved that the City Attorney be authorized to prepare necessary ordinance amending Condition No.1 of Ordinance No. 1157 from, a,parcel of land 20 feet in width be reserved on each side of the property for ingress and egress to the parking area, t09 25 feet on one side of the property.. AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING CONDITION NO. 1 OF ORDINANCE NO. 1157 RELATING TO A CHANGE OF ZONE IN A CERTAIN AREA OF THE CITY. (F-56-57-42) After hearing read in full the title of Ordinance No. 1385 and having knowledge of the contents thereof, Councilman Coons moved the reading in full of said Ordinance be waived. Mr. Piersall reported that the final map conforms substantially to the tentative map previously submitted; that necessary fees have been paid and required bonds posted, and recommended the acceptance of said final map. On the recommendations of the City Engineer, final map, Tract No. 2775, was approved by the City Council on motion by Councilman Coons, seconded by Councilman Schutte.
