69R-698 - RESOLUTION NO. 69R- _~.Q~__ A RESOLUTION OF THE CITY COillJCIL OF THE CITY OF &~AHEIM ~lliNDING RESOLUTION 69R-598 AUTH- ORIZING THE EXECUTION OF &~ AGREE~mNT WITH THE COUNTY OF OP~GE WITH REFEllliNCE TO A LIGHTING AND TRAFFIC SIGNAL SYSTEM AT THE INTERSECTION OF BALL ROAD AND GILBERT STREET. WHEREAS, the City Council did heretofore, to wit, on October 21, 1969, adopt Resolution No. 69R-598 authorizing the execution of an Agreement with the County of Orange with reference to a Lighting and Traffic Signal System at the intersection of Ball Road and Gilbert Street; and WHEREAS, Section 4 of Resolution No. 69R-598 reads as follows~ "4. COST. The proportionate share of costs to be borne by the respective parties shall be based on contract prices, and it is agreed that County's share shall be 50% (1/2) of the cost of the Project and City's share of the cost shall be 50% (1/2) of the cost of the Project. It is estimated that the total cost of the installation will be approximately ~venty Thousand Dollars ($20,000.00) plus engineering and contingencies. In addition to its proportionate share of construction and installation cost, the County shall pay 50% (1/2) of the design, survey and construction engineering costs.1i AI\ID WHEREAS7 the City Council finds that said Section 4 should be changed to read as follows: "4. COS'l'. The proportionate share of costs to be borne by the respective parties shall be based on contract prices, and shall be in the ratio of the number of traffic legs of the intersection lying within the County to the total number of legs entering the intersection, as the City limits exist at the time the City advertises e1e contract for the Project. As of the date of this Agreement, it is agreed that the City's share is considered to be three~eighths (3/8) or 37 1/2% of the cost of the Project, based on the fact that one and one-half (1 1/2) legs of the intersection presently lie within the City and the County's share is considered to be five-eighths (5/8) or 62 1/2% of the cost of the project, based on the fact that two and one-half (2 1/2) legs of the intersection lie within the County area. It is estimated that the total cost of the installation will be approximately Twenty Thousand Dollars (~20,000.00) plus engineering and contingencies. In addition to its proportionate share of construction and installation cost, the County shall pay 62 1/2% of elC design, survey and construction engineering costs". '-1- - ,-- AND WHEREAS, Section 5 of Resolu~ion No. 69R-598 reads as follows: "5. MAINTENANCE. After the completion of the installation, the traffic signals shall be maintained by City and County shall pay to City upon submission of said maintenance and energy costs, 50% (1/2) of the total amount." ~BD vmEP~ASl the City Council finds that said Section 5 should be changed to read as follows: "5. NAINTENANCE. After completion of the installation, it is mutually agreed by the parties hereto that; A. City shall maintain said traffic signal installation. B. The maintenance and operational costs for said traffic signal and intersection light- ing installation shall be borne by the parties hereto in accordance with the terms of the traffic signal and highway lighting maintenance Agreement No. 1269-327, executed concurrently with this agreement." NOW, THEREFORE, BE IT RESOLV'im by the City Council of the City of Anaheim that Resolution No. 69R-598 be, and the same is hereby amended to read as follows: "4. COST. The proportionate share of costs to be borne by the respective parties shall be based on contract prices, and shall be in the ratio of the number of traffic legs of the intersection lying within the County to the total number of legs entering the intersection, as the City limits exist at the time the City advertises the contract for the Project.
