69R-661 RESOLUTION NO. 69R-661 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2130 (IN PART) . WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Paul Treat, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the West half of the West half of the Northeast quarter of the Northeast quarter of Section 14, Township 4 South, Range 11 West, City of Anaheim, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, Page 11 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the West line of Tract No. 4230, said point being South 000 16' 08" East, 779.54 feet from the Northwesterly corner of said Tract No. 4230, as shown on a Map recorded in Book 243, Pages 43 and 44 of Miscellaneous Maps, records of said Orange County, said point being the intersection of said West line and the Westerly prolongation of the centerline of Del Nonte Drive as shown on said Nap, said point being the beginning of a non tangent curve concave Northerly and having a radius of 800.00 feet, a radial line through said point bears South 00 16' 08" East, thence Westerly along said curve through a central angle of 110 40' 15" an arc dis- tance of 162.96 feet to a point in a reverse curve concave Southerly and having a radius of 800.00 feet, a raqial line through said point bears North 110 24' 07" East; thence Westerly along said curve through a central angle of 110 40' 47" an arc distance of 163.08 feet to a tangent line; thence along said tangent line South 890 43' 20" West, 8.56 feet to the West line of said West half of the West half of the Northeast quarter of the Northeast quarter; thence along said West line North 000 181 05" West, 720.00 feet; thence leaving said West line, North 890 401 53" East along a line parallel with the North line of the Northeast quarter of said Section 14, 40.00 feet; thence North 440 40' 53" East 28.28 feet to the South line of the North 66 feet of said West half of the West half of the Northeast quarter of the Northeast quarter conveyed to the State of California by deed recorded February 5, 1957, in Book 3792, Page 344, Official Records of said Orange County, thence along said South line, North 890 40' 53" East 272.76 feet to said Northwesterly corner of said Tract No. 4230; thence South 000 16' 08" East 779.54 feet to the point of beginning. Excepting therefrom the northerly 200 feet. AND WHEREAS, the City Planning commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on October 6, 1969, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- _"_,'.L,,,,,,,,,,,',._._._,~i ~. WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and its behalf, and after due consideration of all evidence and re- ports offered at said hearing, did adopt Resolution No. PC 69-203, approving (in part) Variance No. 2130, subject to the conditions therein set forth; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in approving (in part) said variance and did set a public hearing thereon to be held on the 18th day of November, 1969, at 1:30 P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the Provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial pro- perty right possessed by other property in the same vicinity and zone and denied to the pro- perty in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW I THEREFORE I BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted (in Part) permitting the establish- ment of a 117-unit one and two-story apartment complex on the property hereinbefore described with waivers of the following Anaheim Municipal Code requirements or limitations, subject to the conditions hereinafter set forth: 1. Minimum distance between buildings (Section 18.28.050 ( 7 -a) . 2. Minimum building site area per dwelling (Section 18.32. 050 (2) . 3. Minimum living unit floor area (Section 18.28.050(3-a). That this variance is granted subject to the following conditions: -2- 1. That this variance is granted subject to the comple- tion of Reclassification No. 69-70-7. 2. That trash storage areas shall be provided in accor- dance with approved plans on file with the Office of the Director of Public Works. 3. That fire hydrants shall be installed as required and determined to be necessary ,by the Chief of the Fire Department. 4. That all air conditioning facilities shall be pro- perly shielded from view. 5. That subject property shall be served by underground utilities. 6. That Conditions Nos 1, 2, 3, 4 and 5, above mentioned, shall be co~plied with prior to final building and zoning inspections. 7. That the owner of subject property shall pay to the City of Anaheim the s~ of $75.00 per mUltiple- family unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos 1, 2, and 3. 9. That the easterly 32 feet of Grand Avenue shall be developed through to Lincoln Avenue, concurrently with this development. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his successors or assigns, to comply with the Anaheim Munici- pal Code and regulations and the Conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
