'1' ,,_r~ 'I:\"'" .. 69R-656 ---...- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT~NG TO ZONING SHOULD BE AMENDED AND THAT T~E BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a p~blic hearing in Reclassification Proceed- ings No. 69-70-6 to consider an amendment to Title 13 of the Anah~im Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioneQ and described, and ~t said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said he~ring, and a recommendation that the pro- posed amendment be a~opted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the lS~h day of November , 19 69 as the time, and the City ouncil Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Couhcil did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. That the owners of subject property shall deed to the City of' Anaheim a strip of land 32 feet in width from the cep.terline of the street along Chippewa Avenue and 47 feet in width on Crescent Avenue includ- ing a 15-fobt radius property line return. 2. That (a) all engineering requirements of the City of Anaheim alopg Crescent Avenue including preparation of improvem~nt plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engine~ri and (b) that street lighting facilities along Cresc~nt and Chippewa Avenues shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and (c) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned require- ments. The engineering requirements along Crescent Avenue shall not be installed until required by the City Engineer. 3. That the owners of subject property shall pay to the City of Anaheim the sum of l5~ per front foot along Chippewa and Crescent Avenues, for tree planting pur- poses. 4. That the sidewalks and driveways shall be installed along Chipp~wa and Crescent Avenues, as required by the City Engine~r and in accordance with standard plans and specificatiQns on file in the office of the City Engineer. 5. Street acce$S to Portion "B" shall be taken from Chippewa Avenue at one driveway only, and will be located in the northern section of Portion IIBI!. 6. That trash $torage areas shall be provided in accordance with approv~d plans on file with the office of the Director of Public Works. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a 6-foot masonry wall shall be constructed along the southwesterly property line of Portion "A" separating it from Crescent Avenue and the Santa Ana Freeway. -3- - 9. That all a~r-conditioning facilities shall be pro- perly shie]ded from view. 10. That subject property shall be served by underground utilities. 11. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1, 2, and 3, above mentioned, ~hall be completed. The provisions of rights gran~ed by this resolution shall become null and void by action of the City Council unless said conditions ~e complied with within 180 days from the date hereof or such further time as the City Council may, grant. 12. That Conditions Nos. 4, 5, 6, 7, 8, 9, and 10, above mentioned, shall be complied with prior to final building ana zoning inspections. 13. That the alignment of the southwesterly parcel boundary adjacent to. Crescent Avenue and the Santa Ana Freeway shall be ap~roved by the City of Anaheim in accordance with plans prepared by the State Division of Highways, prior to be9inning of construction of Phase II and Phase III of subject development. 14. That the ow~ers of subject property shall pay to the City of An~eim the sum of $75.00 per mUltiple-family unit, to be used for park and recreation purposes, said amount to be paid at the time the building per- mit is issued. BE IT FURT$:ER RESOLVED that the City Attorney be, and he is hereby authorited and directed to prepare and submit to the City Council an ordi*ance amending Title 18 of the Anaheim Munici- pal Code to accompli$h the objects herein found and determined to be necessary and pro~er.
