80R-469 RESOLUTION NO. 80R -469 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. Rp_Ri_c to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and apprcvPd the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should he adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following de- scribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1: The Northerly 98 feet of the Northerly 5 acres of the following: The East half of the North- east quarter of the Southeast quarter of Section 14, in Township 4 South, Range 11 West, San Bernardino Base and Meridian; Excepting therefrom said East half of the Northerly 679.46 feet thereof; Excepting from said North- erly 98 feet the Easterly 40 feet thereof as granted to the State of California by deed -1- 80 -81 -5 ATT V -18 -C P- recorded March 1, 1951, in Book 2151, Page 448, Official Records in the office of the County Recorder of said Orange County; Also excepting from said Northerly 98 feet the Westerly 270 feet thereof. Parcel 2: The Easterly 9.5 feet of the Westerly 279.5 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, S.B.B. &M. Excepting therefrom the Northerly 679.46 feet of said East one -half; Excepting from the Easterly 9.5 feet the Northerly 95 feet; Parcel 3: The Southerly 10 feet of the Northerly 105 feet of the Easterly 170 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, S.B.B. &M. Excepting from said East one -half the Northerly 679.46 feet thereof. Excepting from said Southerly 10 feet of the Easterly 40 feet thereof as granted to the State of California by deed recorded March 1, 1951, in Book 2151, Page 448, Official Records, in the office of the County Recorder of said Orange County. Parcel 4: The Westerly 270 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, San Bernardino Base and Meridian; Excepting therefrom the Northerly 679.46 feet of said East one -half. -2- be excluded from the "RS -A- 43,000" (RESIDENTIAL /AGRICULTURAL) Zone and incorporated into the "RM -3000" (RESIDENTIAL, MULTIPLE - FAMILY) Zone, subject to the following conditions: 1. That an ordinance rezoning the subject property shall in no event become effective except upon or following the recordation of Final Tract Map No. 11211 within the time specified in Government Code Section 66463.5 or such further time as the advisory agency or City Council may grant. 2. That completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 2102. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18, of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
