69R-598 RESOLUTION NO. 69R- 598 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE COUNTY OF ORANGE WITH REFERENCE TO A LIGHTING AND TRAFFIC SIGNAL SYSTEM AT THE INTERSECTION OF BALL ROAD AND GILBERT STREET. WHEREAS, considerable traffic congestion presently exists and is progressively increasing at the inter- section of Ball Road and Gilbert Street in the City of Anaheim, California, County of Orange; and WHEREAS, a study has been completed and the con- clusion drawn that traffic conditions at said inter- section warrant the modification of existing span wire traffic signals to provide for the proper and orderly movement of traffic; and WHEREAS, the City of Anaheim and the County of Orange are willing to cooperate in the modification of the required traffic system and in the contribution to the maintenance of said system subsequent to modification. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that an agreement be made and entered into between the City of Anaheim and the County of Orange, providing for the joint modification of the required traffic signal system and for the contribution to the maintenance of said system subsequent to modification at the intersection of Ball Road and Gilbert Street upon the following terms and conditions: 1. The traffic system shall consist of a modular solid state, expansible controller, standard signal indications and luminaires mounted on approved poles with hardware all conforming to City of Anaheim and County of Orange specifi- cations. 2. CI'I'Y SHALL: A. Prepare the detailed plans, specifications and estimates for the project. B. Have jurisdiction of the construction area within City and County. c. Be and is hereby designated as the contracting and construction agent for the parties to do and perform all acts and things necessary or required in order to construct the Project in accordance with the plans and specifications, including material control, inspection and construction work, and to execute and deliver all documents necessary or required in connection with the construction and completion of said Project, including certificate of day labor, equipment and material costs and certificate of com- pletion of the Project. D. Upon completion of the Project, submit a full, true and correct copy of documents, certificates and itemized bills to County, setting forth the construction and instal- lation costs and costs of design, survey and construction engineering. 3 . COUNTY SHALL: A, Approve the plans and specifications for said project. B. If necessary, prepare maps and deeds for all additional rights of way in the County. c. If necessary, acquire the rights of way for its portion of the Project and certify to City that such acquisition will be accomplished prior to award of contract. D. At all times during the progress of construc- tion of the Project have access to the work for the purpose of inspection thereof and should County deem any remedial measures to be necessary, County shall notify City thereof. E. Reimburse City and pay to City County's share of all tile costs within thirty (30) days after the submission of the statement of the con- struction and installation costs and costs of design, survey and construction engineering as hereinbefore mentioned. 4. COST. The proportionate share of costs to be borne by the respective parties shall be based on contract prices, and it is agreed that County's share shall be 50% (1/2) of the cost of the Project and City's share of the cost shall be 50% (1/2) of the cost of the Project. It is estimated that the total cost of the installation will be approximately Twenty Thousand Dollars ($20,000.00) plus engineering and contingencies. In addition to its proportionate share of construction and installation cost, the County shall pay 50% (1/2) of the design, survey and construction engineering costs. 5. ~~INTENANCE. After the completion of the instal- lation, the traffic signals shall be maintained by City and County shall pay to City, upon sub- mission of said maintenance and energy costs, 50% (1/2) of the total amount. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute said agreement for and on behalf of the City of Anaheim.
