RESOLUTION NO. 69R- 593
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING AN EASEMENT GRANT DEED CONVEY-
ING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY
FOR AN EASEMENT FOR ROAD AND PUBLIC UTILITY
PURPOSES, AND AUTHORIZING THE PAY~mNT THEREFOR.
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property
for municipal purposes, to wit: an easement for road and public
utility purposes; and
WHEREAS, the owners of said property have offered to
sell and convey the same to the City, upon the following terms
and conditions:
1. Exchange Lot B and that portion of Lot A of Tract
No. 4533 adjacent to and north of grantor's pro-
perty. Pay grantor the sum of $444.50 for cost
of grading said area.
2. Install full street improvements, including re-
placing concrete driveway and apron. Said drive-
way to be installed off Chaucer Street to a setback
of 25 feet. The location to be in line with future
garage which the grantor will have constructed.
3. Install 5.00 foot concrete block wall along the
south line of the property with 3 foot opening for
gate. The wall to be stepped down to 3 feet at
corner to meet City requirements. Grantor to
furnish and install gate.
4. Pay grantor the sum of $180.00 for the loss of 36
rose bushes. Owner to replace and plant.
AND WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of Anaheim
to accept said offer and purchase said real property upon said
conditions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of TONY A. DE LAO and CHONITA R.
DE LAO, husband and wife, to sell to the City of Anaheim, upon
the hereinbefore mentioned terms and conditions, the following
described real property situated in the City of Anaheim, County of
Orange, State of California, to be used for an easement for road
and public utility purposes, and more particularly described as
follows:
An easement for road and public utility purposes over, under
and across the Southerly 45.00 feet of the Easterly 80.00
feet of the westerly 189.00 feet of the Southwest quarter of
the Southeast quarter of the Northwest quarter of Section 13,
Township 4 South, Range 10 West, in the Rancho San Juan Cajon
de Santa Ana, as per map recorded in Book 51, page 10 of
Miscellaneous Maps, records of Orange County, California.
Grantor also grants to the City of Anaheim all vehicular
access rights appurtenant to the grantor's remaining
property to and from Wagner Avenue.
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized and directed to execute on behalf
of the City a grant deed in favor of Tony A. De Lao and Chonita R.
De Lao, of the easterly 80 feet of Lot A and all of Lot B of
Tract No. 4533.
AND BE IT FURTHER RESOLVED that the Director of Finance
of the City of Anaheim be, and he is hereby, authorized and
directed to pay to Tony A. De Lao and Chonita R. De Lao, at 2233
Wagner Avenue, Anaheim, California, the sum of $624.50, represented
as follows: $444.50 for cost of grading and $180.00 for the
replacement and replanting of 36 rose bushes.
