69R-584 RESOLUTION NO. 69R- 584 --------------- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS IMPERIAL HIGHWAY-ESPERANZA ANNEXATION. WHEREAS, the owners of the property described herein did petition to the Local Agency Formation Commission for annexation of uninhabited territory to the City of Anaheim; and WHEREAS, said Local Agency Formation Commission authorized the City of Anaheim to annex said territory without notice and hearing and without an election pursuant to the authority vested in said Commission by Section 54797.1 of the Government Code; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is uninhabited territory. That said consent contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council of the City of Anaheim is authorized to approve said annexation by resolution without notice and hearing pursuant to the approval of said Local Agency Formation Commission and Section 35310.1 of the Government Code. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim finds: That the Local Agency Formation Commission of Orange County did receive a written consent signed by all of the owners of the land within the territory proposed to be annexed to said City of Anaheim. That said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabited territory. That said consent signed by all of the owners of land within the territory proposed to be annexed contained a description of said territory in words and figures as hereinafter in this resolution described. That on the 10th day of September, 1969, the Local Agency Formation Commission duly adopted Resolution No. 69-137 in which said Commission authorized the City of Anaheim to annex said territory in accordance with Section 54797.1 of the Government Code and further approved such annexation of said territory without notice or hearing, pursuant to Resolution No. 69-149 adopted October 8, 1969. That the Local Agency Formation Commission further, by resolution, authorized the City Council of the City of Anaheim to annex said territory without notice or hearing by the City Council and without the require- ment that an election be held by the City on the question of said Annexa- tion. BE IT FURTHER RESOLVED that the Annexation of the territory included within the boundaries of the Imperial Highway-Esperanza Annexation, more particularly described as follows, to wit: IMPERIAL HIGHWAY - ESPERANZA ANNEXATION (REVISED) TO THE CITY OF ANAHEIM That portion of allotments in decree of partition of the Rancho Canon de Santa Ana in the County of Orange, State of California, rendered in Case No. 1978 in the 17th Judicial District Court of California, a certified copy of which was recorded February 8, 1874 in Book 28, page 158 of Deeds Tn the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point in the Easterly City Boundary, as said Boundary was established by the Yorba Annexation to the City of Anaheim by Ordinance No. 1777, dated August 10, 1964, said point lies South 10 23' 00" West, 120.15 feet, and North 880 31' 41" East, 114.17 feet from the centerline intersection of Esperanza Road and Imperial Highway, said point of beginning also lies South 880 31' 41" West, 38.79 feet from the Northeasterly corner of the land described in the Deed to the State of California recorded in Book 3693, page 374 of Official Records; thence South 10 23' 00" West, 319.61 feet, along said City Boundary to a point in the Easterly line of land described in the Deed to the State of California, recorded in Book 2395, page 522 of said Official Records; thence along said Easterly line and said City Boundary the following courses and distances: South 10 23' 00" West, 664.09 feet; North 880 37' 00" West 20.00 feet; South 10 23' 00" West 131. 00 feet; South 660 48' 55" East, 53.85 feet; South 10 23' 00" West 20.00 feet; South 69034' 55" West, 53.85 feet; and South 1023' 00" West 291.93 feet, to an angle point in said City Boundary as established by Santa Ana Canyon Annexation No. 1 by Ordi- nance No. 2471, dated February 29, 1968; thence leaving said Easterly line along said City Boundary, South 560 19' 06" East, 88.02 feet; thence leaving said City Boundary, North 780 23' 00" East, 1239.49 feet, to the beginning of a curve concave Northwesterly, having a radius of 5,780.00 feet; thence Northerly and Easterly along said curve, through a central angle of 150 14' 27", an arc length of 1537.50 feet; thence leaving said curve, North 10 15' 37" West, 119.80 feet; thence North 10 30' 56" East, 944.95 Imperial Highway - Esperanza Annexation (Revised) To The City of Anaheim (Con ti nued) in a non-tangent curve concave Northwesterly having a radius of 5,779.63 feet, a radial line drawn throush said point bears South 200 30' 23" East, said curve being also the Southerly line of the strip of land, 100.00 feet wide, as conveyed to the Riverside, Santa Ana and Los Angeles Railway Company by deed recorded July 7, 1886 in Book 164, page 508 of Deeds, records of Los Angeles County, California, said 100.00 foot strip being now vested in the Atchison, Topeka and Santa Fe Railway Company, a corporation; thence Southwesterly along said curve and said South line, through a central angle of 190 02' 04", an arc length of 1920.08 feet; thence continuing along said South line, South 880 31' 41" West, 979.27 feet, to the point of beginning. is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the IMPERIAL HIGHWAY-ESPERANZA ANNEXATION to the City of Anaheim. BE IT FURTHER RESOLVED that from and after the date of the adoption of this resolution and the filing of a certified copy thereof with the Secre- tary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim contracted prior to or existing at the time of such annexation pursuant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this resolution.
