AS THE LA PALMA-FEE ANA ANNEXATION DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED 1\ND GIVING NOTICE OF THE DAY, HOUH 1\I\ID PLACE ~VHERE AND miEN ANY PERSON OWNING REAL PROPERTY ~vI'I'HIN SUCH TERRITORY SO PROPOSED TO BE fu'\jNEXED ~ffiY APPEAR BEFORE THE CITY COUNCIL AND SHmv CAUSE \"i'HY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. \vHEREAS, the City CouncIl of the CI ty of Anaheim did on the 14th day of October , 19 69 , receive a written pet~tion asking that certain new terrItory described~n said petItIon be annexed to the CIty of AnaheIm; and \'7HEREAS, prIor to the cIrculation or filIng of said petitIon, notice of Intention to annex saId territory, contain- Ing the specific boundarIes of the terrItory to be annexed, was fIled wIth the Local Agency Format.lon Comnnssion; and WHEREAS, sal.d Local Agency Format Ion Cornrniss ion has rendered Its deCISIon, as provIded In Section 54797 of the Government Code, approving saId annexatIon; and vJHEREAS, saId t.err Itory proposed to be annexed to said Clty of AnaheIm IS situated In the County of Orange, State of CalIfornia, and IS contIguous to the CIty of Anaheim and is unInhabited terrItory, and saId pet1tlon contained a description of said terrItory 1n words and fIgures as hereinafter in this resolut1on described; and \'JHEREAS, the C:l t.y Coune 11 fInds from evidence and reports recelved that at the tIme of the fIling and receipt of said petitlon, It was and now IS s1gned by owners of not less than one-fourth 1/4) of the land In the territory by area and by assessed value In the terrItory proposed to be annexed, according to the last preceding equalIzed county assessment roll; and vJHEREAS, the CIty Counci 1 f Inds from evidence and reports received and from saId petltlon that at the time of the fl1~ng and presentatlon of sald petItIon that said new terr.ltory proposed to be annexed to saId CIty of Anaheim did not form a part of any munIClpal corporatIon and that said terrItory was uninhabited and is contiguous to the City of AnaheIm; and WHEREAS, the Cr.ty CouncIl finds from said petition and eVIdence and reports receIved that the boundaries of the terrltory so proposed to be annexed t.o the CIty of Anaheim are as follows, to WIt: LA PALMA-FEE ANA ANNEXATION TO THE CITY OF ANAHEIM That parcel of land located in the County of Orange, State of California, described as follows: Beginning at a point in the existing City limit line of the City of Anaheim as established by the Northeast Annexation No. 3 to the City of Anaheim, passed by Ordi- nance No. 1542, January 17, 1961, filed with the Secre- tary of State July 10, 1964 and recorded July 13, 1964 in Official Records of Orange County, California, said point of beginning being distant North 890 481 10" East 30 feet from the centerline intersection of La Palma Avenue (formerly known as Walnut Street) and Fee Ana Street, as said intersection is shown on a Record of Survey Map filed in Book 79, page 1 of Record of Surveys in the office of the County Recorder of said Orange County, California; thence North 00 11' 50" West 398.35 feet along a portion of said existing City limit line of the City of Anaheim, being a line parallel with and 30 feet Easterly of the centerline of said Fee Ana Street, to an intersection with the South line of the North 143.52 feet of Lot 13, Block 36 of the Yorba Linda Tract, as shown on a Map recorded in Book 5, pages 17 and 18 of Miscellaneous Maps, records of Orange County, California; thence North 890 48' 10" East 617.00 feet continuing along a portion of the said existing City limit line of the City of Anaheim, being a portion of the South line of the North 143.52 feet of Lot 13, Block 36 of said Yorba Linda Tract to an intersection with the Westerly line of the land des- cribed in deed recorded October 14, 1966 in Book 8075, n~nQ 7Q? ~~ ~~~;~~~, D____~_ _~ La Palma - Fee Ana Annexation To The City of Anaheim (Con tinued) an intersection with a line parallel with and 53 feet Southerly of the centerline of the aforementioned La Palma Avenue (formerly known as Walnut Street); thence North 890 48' 10" East 196.13 feet along said parallel line to an intersection with the Westerly line of the parcel of land designated as Parcel 3 shown on a Record of Survey Map filed in Book 79, page 1 of Record of Surveys in the office of the County Recorder of said Orange County, California; thence North 00 11' 50" West 23 feet along a portion of the Westerly line of the last mentioned parcel of land to an intersection with a line parallel with and 30 feet Southerly of the centerline of said La Palma Avenue; thence North 890 48' 10" East 194.00 feet along the last mentioned parallel line to an intersection with the West- erly line of the land described in deed recorded March 30, 1960 in Book 5170, page 107 of Official Records of Orange County, California; thence South 00 11' 50" East 432.00 feet along the Westerly line of the land described in the last mentioned deed to the Southwesterly corner of said land; thence South 890 48' 10" West 1007.13 feet along a line parallel with the centerline of the aforementioned La Palma Avenue to an intersection with a line parallel with and 30 feet Easterly of the centerline of said Fee Ana Street, said point of intersection being a point in the existing City limit line of the City of Anaheim, as estab- lished by the aforementioned Northeast Annexation No.3; thence North 00 11' 50" West 462.00 feet along the last mentioned parallel line, being a portion of the said exist- ing City of Anaheim City limit line to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as LA PALMA-FEE ANA ANNEXATION and- that notice of such proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have peti- tioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section 35311 of the Government Code. BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their consents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 25th day of November 1969 , at the hour of 1:30 0' clock P.M., at the City Council Chamber in the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed; and that at any time before the closing of said hearing on protests, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Sa~d protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she ~s hereby, authorized and directed to cause a copy of this reso- lution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circula- tion, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: the P1acentia Courier and that such publication shall be completed at least twenty (20) days prior to the date of hearing herein- above specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexa- tion to be mailed to the Board of Supervisors of such Countv. this THE FOREGOING RESOLUTION is approved and signed by me 14th day of October , 19 ~ ATTEST: /) /J{;A ',/, ...
