RESOLUTION NO. 69R- 582
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT BETWEEN THE
CITY OF ANAHEIM AND THE COUNTY OF ORANGE,
WITH REFERENCE TO ROADWAY IMPROVEMENTS ON
SUNKIST STREET AND BALL ROAD.
WHEREAS, the City of Anaheim is proposing to construct
roadway improvements on Sunkist Street from 670 feet north of
Ball Road to Ball Road and Ball Road from Sunkist Street to
1320 feet west of Sunkist Street; and
WHEREAS, portions of the proposed improvements are
in the County of Orange; and
WHEREAS, the County and the City consider it in the
best interests of economics and public safety to combine the
improvements in their respective jurisdictions into one project;
and
WHEREAS, the County and City desire to enter into
an agreement for the construction of said roadway improvements
on Sunkist Street and Ball Road providing for the construction
of the County's portion of said project in conjunction with
the City's construction work and the reimbursement to the City
by the County for said portion.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement this day submitted
to the City Council to be made and entered into by and between
the City of Anaheim and the County of Orange, providing for
the combined construction of the City's and County's portions
of the roadway improvements on Sunkist Street from 670 feet
north of Ball Road to Ball Road and Ball Road from Sunkist Street
to 1320 feet west of Sunkist Street, upon the following terms
and conditions:
I. City shall:
A. Be and is hereby designated as Project Engineer,
Contracting and Construction Agent for the parties
to do and perform all things necessary in order
to design and construct the proposed improvement
of Sunkist Street and Ball Road, within the limits
noted above, and to execute and deliver all documents
required in connection with the construction
and completion of said Project, including Certificate
of Cost and Certificate of Completion of Project.
B. ~uring the period of construction, have jurisdiction
over the construction area, including that portion
of the Project within County area.
II. County shall:
and should County deem any remedial measures
to be necessary, County shall notify City there-
of. Reimburse and pay City for all construction
costs for work done within the County.
III. The total estimated cost for the County portion
is presently $9,300.00, which sum includes an estimate
of the engineering and overhead for the County portion.
IV. County's share of the construction cost shall be
determined on the amount of work done on said portion
of roadway lying within its boundaries, as these
boundaries exist at the time of advertising the
project. In this agreement "roadvlay" shall be defined
to include, in addition to work within, on and in
the travel lanes, the proper construction of shoulders,
drainage ditches, and all necessary and pertinent
work as shown on the contract plans.
V. Upon completion of construction of said portion
of roadway, the City shall submit full, true and
correct copies of documents, certificates and itemized
bills to said County, and County shall reimburse
City within thirty (30) days upon sUbmission of
such costs. Such bills shall be based on the actual
quantities of construction and the unit prices bid
for the contract and shall contain a charge for
engineering and inspection in the same proportion
to the total eqgineering and inspection costs as
the proportion of contract cost for the portion
within County is to the total contract cost, plus
a charge for overhead on the engineering and inspection
performed by the City, and exclusive of administrative
overhead.
