69R-574 IillSOLUTION NO. 69R-574 -_..,._,.,---~- A RESOLUTION OF THE CITY COUNCIL OF THE CI'I'Y OF ANAHEIN GEk.'II'rING VARIl\NCE NO. 2113 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from William and Nin~ Simmons, owners; James HOdges, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lots 5 and 6, and the North half of Lot 7, of Tract No. 796, in the City of Anaheim, County of Orange, State of California, as per map thereof recorded in book 24, page 28 of Miscellaneous Maps, records of said Orange County. That portion of Lot 1 in Block A of Tract No. 796, in the City of Anaheim, County of Orange, State of California as per map recorded in book: 24, page 28 of Miscellaneous Maps, records of said Orange County, said land being bounded as follows: On the North by the Westerly prolongation of the North line of Lot 5 of said Tract No. 796, and on the South by the ~vesterly prolongation of the South line of the North half of Lot 7 of said Tract No. 796. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said peti tion on ~l'Jl1~t? There are exceptional or extraorclnary CIrcum- stances or conditIons applicable to the property Involved or to the intended use of the property that do not apply generally to the property or class of use in the same viCInity and zone, 2. That such a varlance is necessary for the preser- vatIon and enjoyment of a substantIal property rIght possessed by other property 1n the same viCInLty and zone and denied to the property In question. 3. That the granting of such variance will not be materially detrimental to the public welfare or InJurious to the property or Improvements in such vicInIty and zone in which the property is located 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan, nm-J, THEREFORE, BE IT RESOLVED by the City Counc d 0 f the City of Anahelm that a conditional zoning variance be, and the same 1.S hereby granted permitting the establishment of a 53-unit apartment complex on the property hereinbefore described with waivers of the following Anaheim Municipal Code requirements or limitations; subject to the conditions hereinafter set forth: l. One-story height limit within l50 feet of an R-A zone, Section 18.28.050 (5-b) 2. Location of accessory buildings, Section l8.28.050 (6-c) 3. Minimum distance between buildings, Section 18.28.050 (7-a) 4. Living units located within 200 feet of a standard street, Section l8.28.050 (9-b) 5. Adequate access and circulation for trash and fire vehicles, Section 18.28.050 (9-a) That this variance is granted subject to the following con- ditions: 1. That this variance is granted subject to the com- pletion of Reclassification No. 63-64-62. 2. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 4. That a 6-foot masonry wall shall be constructed along the west property line. 5. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes. 6. That subject property shall be served by underground utilities. 7. That the 54-foot diameter turning area shall remain free and clear of all structures or obstructions. 8. That Conditions Nos. 2, 3, 4, 5, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspections. 9. That the owners of subject property pay to the City of Anaheim parks & recreation fees of $75.00 per multiple family unit to be used for park and recreation purposes, said amount to be paid at the time the building permit. is issued. 10. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 (Revision No 2), 2, 3, and 4, subject to approval by the Fire Chief and the Development Services Depart- ment. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply witl1 the Anaheim 11unicipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim L'lunicipal Code unless otherwise specified herein.
