69R-554 RESOLUTION NO. 69R-554 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 1120, WITHOUT PREJUDICE. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from the City Council of the City of Anaheim, 204 East Lincoln Avenue, Anaheim, California, to establish a Metroport with related facilities on the following described property: Beginning at the southwest corner of Lot 3 of said Tract No. 71, said point being the centerline intersection of State College Boulevard and Orangewood Avenue; thence North 00 08' 00" West along the west line of said lot, 667.79 feet; thence East, parallel to the south line of said Lot 3, 3020 feet, more or"less, to a point in the existing City of Anaheim City Limit line as established by the Katella Annexation to the City of Anaheim, passed by Ordinance No. 1119, January 30, 1957, filed with the Secretary of State March 4, 1957 and recorded in the office of the County Recorder of said county; thence along said City Limit line, South 220 00' 00" West, 1170 feet, more or less, to an angle point therein; thence continu- ing along said City Limit line, South 110 53' 00" West, 735 feet, more or less, to an angle point therein; thence Westerly, continuing along said City Limit line, 1637 feet, more or less, to an angle point therein; thence Northerly along the east line of that certain parcel shown on a Map filed in Book 15, page 24 of Record of Surveys in the office of the County Recoraer of said county, 205.43 feet to the northeast corner thereof; thence westerlv 10 feet, more or less, to the east line of Orange County Flood Control District's Southeast Pillaheim Channel, 20 feet wide; thence northerly along said east line, 910 feet, more or less, to a point in the center- line of Orangewood Avenue, 90 feet wide, said centerline also being the south line of said Lot 3; thence westerly along said south line, 785 feet, more or less, to the point of beginning. Excepting therefrom that portion included within said Orange- wood Avenue and said State College Boulevard. AND WHEREAS, the City Planning Commission did hold a public hearing at the Anaheim StadiQ~ in the City of Anaheim upon said request on June 18, 1969, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC 69-146 granting Conditional Use Permit No. 1120, subject to certain conditions therein set forth; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council .;.1..:"':1 _"1 and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and decision on said application was continued to October 7, 1969, to allow further Council study and investigation; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 1120 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Citv of Anaheim that the action of the City Planning Com- mission granting Conditional Use Permit No. 1120 be, and the same is hereby disapproved, and that the request of the City Council of the City of Anaheim to establish a Metroport with related facilities, be, and the same is hereby denied without prejudice.
