A RESOLUTION OF THE CITY COm~CIL OF THE
CITY OF ANAHEIM APPROVING AN AGREE~IENT
HIRING H. WALLACE JAYNES AND R. E.
CAMPBELL DOING BUSINESS AS ORCA DIVING
SERVICE TO PERFORM CERTAIN WORK ON NOHL
RANCH LAKE AND AUTHORIZING THE MAYOR AND
CITY CLERK TO SIGN AN AGREEMENT EViPLOYING
ORCA DIVING SERVICE.
WHEREAS, CITY owns and operates a water reservoir
known as "Nohl Ranch Lake" in conjunction with its water dis-
tribution system; and
WHEREAS, CITY desires to inspect and perform work on
said reservoir; and
WHEREAS, ORCA is qualified to perform said inspection
and work and has expressed a desire to perform same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement between the City of Anaheim
and H. Wallace Jaynes and R. E. Campbell be, and same is hereby
approved on the following terms and conditions:
I. ORCA will:
A. Prepare, modify and relocate a 30' by 16' barge
presently located in the ocean to Nohl Ranch Lake.
Said preparation and modification shall include
mooring and relocation of the barge to Nohl Ranch
Lake and removal from Nohl Ranch Lake and all acts
necessary to prevent contamination of Nohl Ranch
Lake by said barge.
B. Inspect said reservoir and install mounding filler
material at the toe of the upstream side of said
reservoir and then place a butyl liner over said
filler material.
C. Use two (2) qualified divers each day diving
operations are conducted.
II. CITY will:
A. Pay for the relocation of said barge to Nohl
Ranch Lake and removal therefrom the sum of
$1,960.00. It being understood and agreed that
eighty percent (80%) of said sum will be paid to
ORCA upon the placing of said barge in Nohl Ranch
Lake.
B. Pay ORCA $299.00 per day for the services of two
qualified divers for each day when said divers
actually dive.
C. Pav to ORCA the sum of $62.25 Der dav for rental
III.
It is estimated that the aforementioned diving services
will take approximately sixteen (16) days.
V.
It is hereby agreed and understood that the total sum
to be paid ORCA hereunder will not exceed the sum of
$8,500.00 without the prior written consent of the
City Council of the City of Anaheim.
CITY will pay to ORCA the remaining balance due under
this agreement withint fifteen (15) days after com-
pletion of the work hereunder and submittal of an
invoice by ORCA.
IV.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute an agreement on behalf of the
City of Anaheim containing the above mentioned terms and condi-
tions.
THE FOREGOING RESOLUTION is signed and approved by me
