A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DECLARING ITS INTENTION TO VACATE
AND ABANDON A POR:fION OF A ROADWAY ADJACENT
TO THE SAN'l'A ANA FREEwAY AND NORTHEAS'I' OF 'l'HE
CENTERLINE INTERSECTION OF BALL ROAD M~D WEST
STREET UPON F ALONG F OVER AND THROUGH THE HERE-
INAFTER DESCRIBED REAL PROPERTY; FIXING A TII~
AND PLACE FOR A HEARING THEREON; DIRECTING THE
POSTING OF NOTICES THEREOF AND THE PUBLICATION
OF THIS RESOLUTION.
WHEREAS, a request has been made for the abandonment
of a portion of roadway upon, along, over and through the property
hereinafter described; and
WHEREAS, the City Council does elect to proceed under
the provisions of the Public Service Easement Vacation Law, Title
5, Division 1, Article 5 of the Government Code to abandon said
portion of said roadway.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it does hereby declare that it intends
to vacate, abandon and close to public use a portion of roadway
located adjacent to the Santa Ana Freeway and Northeast of the
centerline intersection of Ball Road and West Street situated in
the City of Anaheim, County of Orange, State of California, more
particularly described as follows:
That portion of an existing frontage road located in the
City of Anaheim, County of Orange, State of California,
being a portion of Dreyfus and others lands, as shown
on a Map of Anaheim Extension surveyed by Wm. Hamel, a
copy of which is filed in Book 3, pages 163 et seq.,
entitled Los Angeles County Maps, in the office of the
County Recorder of Orange County, California, described
as follows:
Commencing at the intersection of the easterly line of
West Street, 66.00 feet wide, as shown on a Map of the
replat of Orchard Park Tract, recorded in Book 7, page
6 of Miscellaneous Mapsf records of Orange County,
California, with the southwesterly line of Manchester
Avenue, 100.00 feet wider as described in Parcel 2 of
Final Order of Condemnation in the Superior Court Case
No. 33172, a certified copy of which final order is
recorded in Book 847, page 478, November 7, 1936, Official
Records of Orange County, California; thence South 150 31'
son East 284.83 feet along the easterly line of said West
Street to an intersection with the northerly line of the
land described in deed to the State of California record-
ed October 13, 1955 in Book 3243, page 14 of Official
Records of Orange County, California; thence North 740 28'
10" East 24 feet along a portion of the Northerly line of
the land conveyed to State of California in the last
mentioned deed to the true point of beginning; thence
52" West 424.62 feet; thence South 740 28' 10" West 8l.19
feet to an intersection with a line parallel with and 57
feet easterly of the centerline of the aforementioned
West Street, thence North 150 31~ SOl! West 40 feet to the
true point of beginning.
and that it does elect to proceed under the provisions of the
Public Service Easement Vacation Lawf Title 5, Division 1, Article
5 of the Government Code.
BE IT FURTHER RESOLVED that reference is hereby made to
a map on file in the Office of the City Clerk for further particu-
lars as to the proposed vacation, abandonment and closing to
public use a said portion of said roadway.
BE IT FURTHER RESOLVED that a time and place for hearing
all persons interested in, or objecting to the proposed vacation
and abandonment shall be fixed not less than fifteen (15) days
from the date of the passage of this resolution. That the 16th
day of ___,_$.E!P:t~I!!Q~.L_______' 1969, at 1:30 o'clock P.M. in the ----
Council Chambers in the City Hall in the City of Anaheim is
hereby fixed as the time and place for a public hearing on the
matter of such vacation, abandonment and closing to public use of
said portion of said roadway for all persons interested in or
objecting to such proposed vacation, abandonment and closing to
public use to appear. and show cause, if any they have, why such
roadway and the use thereof for the purposes hereinabove mention-
ed should not be vacated, abandoned and closed to public use.
BE IT FURTHER RESOLVED that notices of such proposed
vacation and abandonment of said portion of such roadway and the
use thereof for the purposes herein mentioned shall be posted
conspicuously along the line of said roadway at least ten (lO)
days before the date set for said hearing. Such notices shall
be posted not more than 300 feet apart and at least three (3)
such notices shall be posted. Such notices shall state the
passage of this resolution of intention and the time and place of
the hearing upon the matter of such vacation and abandonment of
said portion of such roadway.
BE IT FURTHER RESOLVED that proof of publication of any
notice required by this resolution shall be made by affidavit as
provided in the Code of Civil Procedure and proof of posint of
any such notice shall be made by affidavit of the person posting
the notice setting forth the facts regarding such posting.
BE IT FURTHER RESOLVED that the City Clerk shall certify
to the passage of this resolution and shall cause the same to be
published in the manner prescribed by law in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and circula-
ted in the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
