69R-384 RESOLUTION NO. 69R-384 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM SUPERCEDING RESOLUTIONS NOS. 3977 AND 7393 IN RECLASSIFICATION PROCEEDINGS NO. 56-57-76. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 56-57-76 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 1st day of July, 1969, as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: All of the area included in the Southeast Annexation, known as Section liB" of the Master Plan of the South- east Section, more particularly described as follows: -1- 56-57-76 Commencing at a point 30 feet distant from the center- line of East Ball Road and 30 feet distant from the centerline of South Placentia Avenue; thence Easterly along the Southerly right-of-way line of East Ball Road a distance of 630 feet more or less; thence Southerly paralel to South Placentia Avenue a dis- tance of 630 feet more or less; thence Easterly parallel to East Ball Road a distance of 660 feet more or less; thence Southerly parallel to South Placentia Avenue a distance of 1920 feet more or less; thence Southwesterly a distance of 190 feet more or less; thence Westerly parallel to East Ball Road a distance of 1100 feet more or less; thence Northerly along the Easterly right-of-way line of South Placentia Avenue, 2580 feet more or less to the point of beginning. EXCEPTING THEREFROM the East half (E 1/2) of the Southwest quarter (SW 1/4) of the Northwest quarter (NW 1/4) and the East 10 feet of the Northwest quarter (NW 1/4) of the Southwest quarter (SW 1/4) of the Northwest quarter (NW 1/4) of Section 24, Township 4 South, Range 10 West, S.B.B. & M. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incorporated in M-l, LIGHT MANUFACTURING ZONE, subject to the following conditions: 1. That a building setback line be established on each side of Winston Road, and on the north side of Cerritos Avenue, and that said setback line be established 50 feet from the center line of said streets. 2. That said setback area be landscaped by the property owner from the setback line to the curb until such time as street widening and sidewalks are required. 3. That a P-L, PARKING-LANDSCAPING ZONE, 50 feet in width, be established along Ball Road and along Placentia Avenue; and that a 26-foot LAND- SCAPING ZONE be established along each side of Winston Road and on the North side of Cerritos Avenue. 4. That the owners of subject property deed to the City of Anaheim the following land for street widening purposes: A strip of land 45 feet in width from the center- line of Ball Road, measured at right angles from said centerline (30 feet existent); A strip of land 53 feet in width from the center- line along Placentia Avenue measured at right angles from said centerline (30 feet existing on most of the land, 50 feet existing on some portions thereof); A strip of land 32 feet in width from the center- line along each side of Winston Road, measured at right angles from said center line (20 feet existing on the north side and variable dedica- tion from 20 feet to full dedication existing on the south side of Winston Road); -2- A strip of land 45 feet in width from the centerline along Cerritos Avenue, measured at right angles from said centerline (full dedication existing on a portion of the land and 20 feet existing on a portion). 5. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, and that said engineering requirements and improvements shall be installed at the time the property is developed. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes at the time the property is developed, or shall install street lights as required and approved by the utilities Director of the City of Anaheim at the time subject property is developed. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
